Por outro lado, constitui-se ainda alvo de alguma discussão, embora a questão já nos pareça, como veremos no presente estudo, adequadamente pacificada, a relativa ao ressarcimento por danos morais no que concerne à pessoa jurídica. O tema do assédio moral, no Direito do Trabalho, vinha sendo pouco explorado pela doutrina brasileira enquanto que a jurisprudência de nossos Tribunais caminhava timidamente, talvez pela falta de questionamentos dos advogados em suas ações. Todavia, com o advento da Constituição Federal de 1988, houve profundas mudanças, trazendo com isso o amadurecimento do nosso sistema jurídico. Verificaremos que a expressão assédio moral é recente no universo do trabalho, apesar de maus-tratos e humilhações serem praticados desde o início das relações de trabalho. O estudo do assédio moral justifica-se pela importância do ser humano no contexto organizacional, buscando conhecer os motivos pelos quais tais práticas comportamentais persistem na atualidade. On the other hand, one still consists white of some quarrel, even so the question already in them seems, as we will see in the present study, adequately pacified, the relative one to the compensation for pain and suffering with respect to the legal entity. The subject of the moral siege, in the Right of the Work, came little being explored for the Brazilian doctrine whereas the jurisprudence of our Courts walked shyly, perhaps for the lack of questionings of the lawyers in its action. However, with the advent of the Federal Constitution of 1988, it had deep changes, bringing with this the matureness of our legal system. We will verify that the expression moral siege is recent in the universe of the work, although bad-treatments and humilhações to be practised since the beginning of the work relations.
