Um dos objetivos deste trabalho é demonstrar a importância do afeto no estabelecimento da filiação, por ser um dos critérios para se definir a filiação socioafetiva. No entanto, para se estabelecer uma filiação baseada na socioafetividade é necessário que a posse de estado de filho esteja configurada, este trabalho então apresenta quais são os requisitos que a doutrina entende serem necessários para caracterizar a posse de estado de filho. Define também uma das espécies da filiação socioafetiva, os filhos de criação, e com base numa pesquisa jurisprudencial e doutrinária, tenta demonstrar a necessidade de proteção jurídica a essa modalidade de filiação e, consequentemente, oferecer aos filhos de criação todos os direitos inerentes a uma filiação.With the appreciation of the affect on family relations and equality among children, brought by the Federal Constitution, family law, including the right of membership, has undergone changes as situations that were previously underserved became legally protected. One purpose of this paper is to demonstrate the importance of affect in affiliation, as a criterion to define the membership socioaffective. However, to establish a membership-based Socio-affectiveness is necessary that the possession of child status is set, this paper then presents what are the requirements which the doctrine would be necessary to characterize the state of possession of child.
