Mediante a essa referência é que no primeiro capítulo se abordará o processo de execução no Brasil, conceituando sua evolução, classificando suas espécies e a reportando à penhora dentro do processo de execução, abrangerá o conceito de penhora, bem como sua efetivação, finalizando com a hierarquia dos bens absolutamente impenhoráveis. Em seguida o segundo capítulo tratará da penhora por meio eletrônico, sua origem e diferença em relação a penhora tradicional, comentará acerca do convênio firmado entre o BACEN e o Tribunal de Justiça que permite a comunicação entre as entidades financeiras e jurídicas, a fim eventual bloqueio de valores referentes à execução, será feita referência às espécies de penhora Online remetendo-se para o último item que trata da penhora Online incidente sobre a conta-salário do devedor. Por fim o terceiro capítulo apresenta os direitos e garantias do devedor solvente, apresentando mudanças legislativas para sua consubstanciação e os princípios fundamentais institucionalizados na CF/88, defendidos pelo Estado. Finalmente, será feita uma abordagem sobre o posicionamento da doutrina e da jurisprudência brasileira enfatizando suas tendências contra e favorável à instituição da penhora via BACEN-JUD. A justificava deste trabalho baseia-se no fato de a penhora Online possuir maior rapidez e transparecer eficiência em localizar valores a serem passíveis de bloqueio em contas em nome do devedor, o que é feito através de mera solicitação por meio eletrônico às Instituições Financeiras. No entanto, embora a penhora Online seja considerada uma espécie de instrumento de grande importância para associar agilidade e eficiência junto ao processo de execução, é necessário que se faça certos ajustes na forma de seu procedimento, para que não persista a violação dos diversos direitos do executado, afrontando inúmeros preceitos e princípios jurídicos que governam a vida em sociedade.This work has for purpose explain concerning the rights and debtor's solvent warranties by means of the electronic garnishment - BACEN-JUD, as well as, juridical consequences, job benefits and inconveniences of this system also known as Online garnishment. By means of to this reference is that in the first chapter will board the execution process in Brazil, judging its evolution, classifying their species and reporting her to the garnishment inside the execution process, it will embrace the garnishment concept, as well as its effectuation, concluding with the hierarchy of the absolutely mace-proof goods.
