Monografia (Graduação) - Universidade Católica de Brasília, Brasília, 2010.https://repositorio.ucb.br:9443/jspui/handle/10869/2734DireitoEste trabalho está ligado ao direito contratual, especificamente ao contrato de compra e venda de imóveis, e também ao direito das obrigações, tendo por objetivo mostrar se a ação de obrigação de fazer e efetiva ou não em face do devedor recalcitrante, e se a relativização do pacta sunt servanda pode gerar insegurança jurídica aos contratos preliminares. Uma grande parcela de compra e venda de imóveis se dá através de contratos preliminares, para posteriormente se efetivar o contrato definitivo, que é a escritura de compra e venda, registrada no cartório de registro de imóveis. Apesar de se ter a propriedade com a transcrição da escritura no cartório do registro de imóveis, o promitente comprador que realizar um contrato preliminar de compra e venda deve estar amparado pela lei. O ser humano por si só, ao mesmo tempo em que quer algo já não quer mais, e é por essa razão que a lei criou mecanismos para o caso de descumprimento dos contratos de compra e venda. Firmado um contrato preliminar, dependendo das cláusulas, as partes não podem exercer o direito de arrependimento, podendo o credor no caso de mora do devedor em realizar o contrato definitivo, ajuizar uma ação de obrigação de fazer e fazer valer o contrato.This work is linked to contract law, specifically the purchase and sale of property, and also the law of obligations, aiming to show whether the action required to make and effective or not in the face of recalcitrant debtor, and if the relativization of pacta sunt servanda can generate legal uncertainty to the preliminary contracts. A large portion of buying and selling real estate is through the preliminary contracts, later to become effective once the definitive agreement, which is the deed of sale, recorded in the Registry of property. While it has the property deed to the transcript of the registry of property registration, the prospective buyer to conduct a preliminary contract of sale must be supported by the law. The human being alone at the same time wants something that no longer want, and that is why the law has created mechanisms for the case of breach of contract of sale.
