União estável poliafetiva: uma breve análise do entendimento jurisprudencial do Superior Tribunal de Justiça e teses contrárias

Resumo: O presente trabalho consiste em abordar e discorrer sobre o instituto da união estável, especificamente sobre o reconhecimento de união estável poliafetiva no Brasil, fazendo um confronto entre o entendimento jurisprudencial do Superior Tribunal de Justiça com teses contrárias. Se resta caracterizada a união estável poliafetiva ou não, caso um relacionamento poliamoroso preencha todos os requisitos legais para a constituição de união estável, é a discussão central do corrente trabalho monográfico. O entendimento jurisprudencial do Superior Tribunal de Justiça aponta atualmente no sentido da impossibilidade deste reconhecimento. Entende-se que vigora no direito brasileiro o Princípio da Monogamia. Além do mais, que há um requisito implícito para que se reconheça união estável consistente no dever de fidelidade. Contrariamente, tem-se que a monogamia não constitui um princípio no direito brasileiro, mas sim uma proibição atinente ao matrimônio. Juntam-se às teses contrárias o fato de que não há nenhum dispositivo legal proibindo essa forma de união estável, e, portanto, há permissão legal para o reconhecimento de união estável poliafetiva.

Whether or not the group marriage becomes characterized, if a polyamorous relationship meets all the legal requirements for the marriage-like relationship, is the central discussion of this monograph study. The jurisprudential understanding of the Superior Tribunal de Justiça currently points towards the impossibility of this recognition. It’s understood that is into effect in Brazilian law the principle of monogamy. Furthermore, there is an implicit requisite for the recognition of the marriage-like relationship consisting on the duty of fidelity. On the other hand, we have that monogamy is not a principle in Brazilian law, but a ban regards to marriage.
