O inquérito policial é onde se busca a materialidade do fato e indícios de autoria. Neste panorama o Parquet tem atuado na investigação criminal, que é o meio onde são colhidas as provas para resolver um crime. Também atribuiu ao Ministério Público, outras funções, como a promoção privativa da ação penal pública, a requisição de diligências investigatórias e o controle externo da atividade policial. O trabalho visa discutir a possibilidade de o Ministério Público atuar na investigação criminal por ser o titular da ação penal. Iniciando-se pelo estudo do Ministério Público demonstrando suas funções e peculiaridades. No segundo capítulo será abordado o inquérito policial, a investigação criminal e a polícia judiciária, principal órgão que realiza a função. No terceiro capítulo trabalhará os sistemas processuais e qual o sistema adotado no Brasil. O último capítulo buscará mostrar a possibilidade de investigação pelo Ministério Público, por meio de pontos relevantes, tanto doutrinários como jurisprudenciais.The Constitution gives the judicial police function, criminal investigation being conducted primarily by the police investigation. The police inquiry is looking where the materiality of the fact and evidence of authorship. In this scenario the Parquet has acted in a criminal investigation, which is a medium where they have gathered the evidence to solve a crime. Also assigned to the Government, other functions such as the promotion of private public criminal action, the request of investigative actions and external control of police activities. The paper seeks to discuss the possibility of prosecutors acting in a criminal investigation to be the holder of the criminal action. Commencing the study of the prosecution proving its functions and peculiarities. In the second chapter will address the police investigation, criminal investigation and police investigators, the main organ that performs the function. The third chapter will work systems and procedures which the system adopted in Brazil.
