Assim, tecem-se considerações sobre sua auto-aplicabilidade, pressupostos processuais, legitimidade ativa e passiva, competência para processo e julgamento e efeitos da decisão. Ademais, realiza-se uma análise da evolução jurisprudencial do Supremo Tribunal Federal quanto à eficácia do Mandado de Injunção. Registram-se os principais aspectos das sessões plenárias da Suprema Corte de 30 de agosto de 2007 e de 25 de outubro de 2007, sessões consideradas marcos históricos para o instituto. Por fim, evidencia-se o atual posicionamento adotado pelo Supremo Tribunal Federal no tocante ao Mandado de Injunção, qual seja Teoria Concretista. Demonstra-se, ainda, que a mudança de paradigma da Suprema Corte não viola o Princípio da Separação dos Poderes.This study aims to evaluate the Injunctive Writ, which consists of a constitutional remedy imposed by the Brazilian Constitution of 1988. Thus, considerations regarding its self-applicability, inadmissibility and active and passive legitimacy, authority to process and trial and effects of the decision will be developed. In addition, there will be an analysis of the evolution of the Brazilian Supreme Court‟s jurisprudence on the effectiveness of the Injunctive Writ. For that, the main aspects of the plenary sessions of the Supreme Court of August 30th, 2007 and October 25th, 2007, which are considered the most important sessions for this institute, were registered. Finally, it was emphasized the current position adopted by the Supreme Court regarding the Writ of Injunction, which is the Concretist Theory.
