Monografia (Graduação) - Universidade Católica de Brasília, Brasília, 2010.https://repositorio.ucb.br:9443/jspui/handle/10869/2277DireitoEste trabalho tem por escopo analisar no aspecto jurídico as novas concepções de família e suas áreas juridicamente conflitantes, visto que legislações anteriores não as regulamentava, pois delimitavam a formação familiar em um breve conceito de união entre marido e mulher, instituída tão somente pelo casamento. Em tempos atuais a legislação admite uniões sem o formalismo do casamento, porém, abrindo a possibilidade que essas uniões posteriormente se transformem em casamento, desde que sejam cumpridos os seus requisitos. O direito é considerado uma técnica eficaz de organização social. O Estado é o responsável pela organização da vida em sociedade e proteção dos indivíduos, coibindo excessos e impedindo colisão de interesses. O legislador ao analisar os fatos da vida, transforma-os em normas jurídicas mediante o estabelecimento de sanções, adjetivando os fatos para que sejam jurídicos. Ainda que o Estado tenha a função de regular as relações entre as pessoas, não poderá ser ele omisso e negligente em garantir o direito à vida, não só a vida como mero substantivo, mas de forma adjetiva: vida digna, vida feliz, como também o direito à liberdade.This work has as scope to analyze the legal aspect of the new conceptions and their family legally conflicting areas, whereas the previous legislation is not regulated, as delimited family background in a brief concept of union between husband and wife set up so only by marriage. In recent times the law allows unions without the formality of the wedding, however, opening the possibility that these unions later turn into marriage, provided that they fulfill their requirements. The right is considered an effective technique of social organization. The state is responsible for the organization of society and protection of individuals, curbing excesses and preventing collision of interests. Legislators to review the facts of life, turns them into rules of law by establishing penalties, adjective facts to be legal.
