Monografia (Graduação) - Universidade Católica de Brasília, Brasília, 2009.https://repositorio.ucb.br:9443/jspui/handle/10869/3126DireitoEsta monografia tem como escopo a análise da responsabilidade penal das pessoas jurídicas em face da lei dos crimes ambientais, que visa punir o causador dos danos ambientais, seja ele pessoa física ou jurídica. A lei surgiu para atender aos anseios da sociedade por medidas mais efetivas para punir os degradadores ambientais. Como antes da Constituição de 1988 não existiam medidas na esfera penal para punir as pessoas jurídicas, os infratores utilizavam essa lacuna legislativa para cometer delitos contra a natureza. Com o passar do tempo, em decorrência das constantes degradações ambientais e da impunidade daqueles que causam estragos ao meio ambiente sadio, o legislador constituinte, por intermédio do artigo 225, § 3º, inovou ao aplicar sanções penais e administrativas para os infratores que causam danos ambientais, ou seja, os entes coletivos. Também a Lei nº 9.605, de 12 de fevereiro de 1988, cognominada Lei dos Crimes Ambientais, prevê punição às pessoas físicas que contribuem para a degradação do meio ambiente, apresentando sanções – penais, civis e administrativas – às condutas e atividades consideradas lesivas ao meio ambiente. Observa-se, dessa forma, uma relevante evolução legislativa no que tange ao meio ambiente. Com o advento dessa Lei, as pessoas jurídicas começaram a ser responsabilizadas no âmbito penal pelos danos causados ao meio ambiente. Corrigiu-se, portanto, a lacuna anteriormente existente nesse sentido.This monograph has as target the analysis of the criminal liability of the legal people in face of the law of the ambient crimes, that aims at to punish the causer of the ambient damages, either it natural person or legal. The law appeared to take care of to the yearnings of the society for measures more effective to punish degrading the ambient ones. As before the Constitution of 1988 they did not exist measured in the criminal sphere to punish the legal people, the infractors used this legislative gap to commit delicts against the nature. With passing of the time, in result of the constant ambient degradações and impunity of that they cause estragos to the healthy environment, the constituent legislator, for intermediary of article 225, § 3º, innovated when applying penalties and administrative for the infractors that they cause ambient damages, that is, the collective beings. Also the Law nº 9,605, of 12 of February of 1988, cognominada Law of the Ambient Crimes, foresees punishment to the physical people who contribute for the degradation of the environment, presenting sanctions - criminal, civil and administrative - to the behaviors and activities considered harmful to the environment. It is observed, of this form, an excellent legislative evolution in what it refers to the environment. With the advent of this Law, the legal people had started to be made responsible in the criminal scope by the actual damages to the environment.
