This dissertation aims to present an objective and analytical exposition on the exploitation of indigenous labor in Brazil from the perspective of preventive and resolute extrajudicial action of the Public Prosecution Service. To this end, the research goes through the search for the historical roots of the exploitation of indigenous labor, from enslavement to the development of hereditary captaincies in the mid-fifteenth century to contemporary slavery; identifying new legal paradigms for the protection of indigenous labor rights at the domestic, international and local levels, led by the 1988 Federal Constitution and ILO Convention 169; and the identification of extrajudicial procedural instruments for the promotion of the social and labor rights of indigenous workers by the Labor Public Prosecutor. Finally, in addition to pointing out these skilled extrajudicial instruments for efficient resolute Ministerial action, the present study presents, based on legislation and reported experience, suggestions for improving one of them, in this case the promotional administrative procedure.
