New approaches to juridical research: empirical research contributions in law

Resumo: This article intends to reflect the current phase of empirical juridical research in Brazil based on a literature review of the subject. Assuming that there are serious structural and historical deficiencies in law research, notably with regard to methodological aspects, thirteen texts were selected on the Journal Portal of the Coordination for the Improvement of Higher Education Personnel (Capes) that address the topic. This analysis allows a comprehensive view on how the theme has been approached and applied in juridical works and what are the challenges that research and law researchers may face when reflecting and using empirical methodologies in their work and analyses. It was possible to verify, then, that empirical research in law has been used in an incipient way and needs improvements to allow better research in the legal field.

Pressupondo-se que há graves deficiências estruturais e históricas na pesquisa em Direito, notadamente quanto aos aspectos metodológicos, foram selecionados treze textos no Portal de Periódicos da Coordenação de Aperfeiçoamento de Pessoal de Nível Superior (Capes) que abordam o tema. Esta análise poderá permitir uma visão compreensiva sobre como o assunto vem sendo abordado e aplicado nos trabalhos jurídicos e quais são os desafios que a pesquisa e o pesquisador em direito poderão enfrentar ao refletir e utilizar metodologias empíricas nos seus trabalhos e análises.
