Some controversial aspects of the principle of subsidiarity:: the unconstitutionality of the Constitutional Amendment Proposal 32/2020

Resumo: The following research analyzes the inclusion of the principle of subsidiarity in the article 37 of the Constitution of the Federative Republic of Brazil, as it is intended by the PEC 32/2020. The article examines this principle's meaning, as well as its consequences related to the constitutional role of the Brazilian State. Besides that, it asserts which are the backgrounds that frames the ideological discourse inclined to the subsidiarity enactment. Later on, Mariana Mazzucato’s work is used as a theoretical framework to deconstruct the false image of tactless State and to demonstrate the importance of an entrepreneurial and active State in order to develop the country. Finally, the constitutional reform limits will be analyzed, which will lead to the conclusion of the possibility to plead the unconstitutionality of the reforms that pretend to mischaracterize the leading role of the State, taking into consideration the respect to the constitutional program.

O artigo examina o significado deste princípio, bem como suas implicações concretas em relação ao papel constitucional do Estado brasileiro. Além disso, perquire quais são os argumentos que embasam o discurso ideológico favorável à adoção da subsidiariedade. Após, utiliza como referencial teórico a obra de Mariana Mazzucato, para desconstruir a imagem falsa do Estado inábil e demonstrar a importância de um Estado ativo e empreendedor para o desenvolvimento do País.
