Legislation for higher education disabled students in Brazil and Portugal: some reflections

Resumo: This study aims to make a critical analysis of legislation regulating the inclusion of disabled students in higher education in Brazil and Portugal. Based on a documentary study, conducted between September and November 2015, the legal standards in recent decades have been analyzed. The results point out different stages of construction of the inclusion policy in the researched countries. It is emphasized that there is a significant variety of norms in the Brazilian context to ensure that these students have equal opportunities, and a scarcity of regulations in Portugal. The legislation has been referred to as an important factor for the development of inclusive education; however it is noteworthy that the existence of legislation does not necessarily imply it is actually complied. Besides legislation, removing barriers for the full participation and learning of disabled students involves awareness, investment in resources, public policy makers and managers’ scientific knowledge to ensure a quality education throughout life for all people.

Con base en un estudio documental, realizado entre septiembre y noviembre de 2015, fueron analizadas las normas jurídicas de las últimas décadas. Los resultados indican etapas diferentes de construcción de la política de inclusión en los países investigados. Cabe señalar la existencia de un número considerable de normativos en el contexto brasileño para asegurar la igualdad de oportunidades de estos estudiantes y una escasez de normativos en Portugal. Se constata que la legislación ha sido referenciada como un importante factor para el desarrollo de la Educación Inclusiva, sin embargo, hay que destacar que la existencia de legislación no implica necesariamente su cumplimiento en la práctica. La eliminación de barreras para el pleno aprendizaje y participación de los estudiantes con discapacidad en la Enseñanza Superior involucra, además de legislación, concienciación, inversiones en recursos y conocimientos científicos por parte de los responsables por la elaboración de políticas públicas y gestores para garantizar una educación de calidad a lo largo de la vida para todas las personas. Este estudo tem como objetivo efetuar uma análise crítica da legislação que regulamenta a inclusão de estudantes com deficiência no Ensino Superior do Brasil e de Portugal. Com base em um estudo documental, realizado entre setembro e novembro de 2015, foram analisadas as normas jurídicas das últimas décadas. Os resultados apontam para estágios diferentes de construção da política de inclusão nos países investigados. É de assinalar a existência de um leque expressivo de normativos no contexto brasileiro para assegurar a igualdade de oportunidades desses estudantes e uma escassez de normativos em Portugal. Constata-se que a legislação tem sido referenciada como um importante fator para o desenvolvimento da Educação Inclusiva, no entanto importa salientar que a existência de legislação não implica necessariamente o seu cumprimento na prática.
