Resumo: It is no longer possible to divide International Law into the law of war and the law of peace. Armed conflicts, particularly urban conflicts, cover a wider spectrum of situations than those provided for by international humanitarian law. The objective of this dissertation is to present the international norms that protect individuals and regulate the use of state force during armed conflicts, both in International Humanitarian Law and in International Human Rights Law, and how they are interact with one another. In particular, it seeks to systematize and identify the role of human rights in protecting individuals during armed conflicts, whether within and outside the conduct of hostilities; and either before, during or after the use of force. This dissertation intends to clarify theoretical issues and connect them to practical and operational challenges, especially those faced in protecting individuals in urban areas.

Os conflitos armados, particularmente os urbanos, abrangem um espectro de situações maior do que os previstos pelo Direito Internacional Humanitário. O objetivo deste trabalho é apresentar as normas internacionais que protegem indivíduos e regulam o uso da força estatal durante conflitos armados, tanto no Direito Internacional Humanitário como no Direito Internacional dos Direitos Humanos, e como elas se relacionam. Em especial, busca-se sistematizar e identificar o papel dos direitos humanos na proteção de indivíduos durante conflitos armados, seja dentro ou fora das hostilidades; seja antes, durante ou depois do uso da força.
