Resumo: | When considering intellectual property law, both trademark registration and a Geographical Indication add value to a product or process, as they are forms of intellectual protection. As such, they can be incorporated into a negotiation to improve the competitiveness of a certain sector of the economy. Some public policies can regulate these issues to enhance competitiveness. However, the impact of these strategies on Brazilian businesses must be observed. This work presents a discussion about the protection of the cachaça product in terms of geographical indication based on the legal framework on the subject and its relationship with trademark registration. The research delved into the quantitative data of trademark registration requests and was used with the aim of presenting the evolution of these registrations, from 2002 to 2022, with observations on approval/disapproval. Finally, an evaluation of the conflict between the legal basis for the geographical indication of cachaça and the registrations of the brands of this distillate. |

Finally, an evaluation of the conflict between the legal basis for the geographical indication of cachaça and the registrations of the brands of this distillate.Ao considerar a Lei de Propriedade Intelectual, tanto o registro de marca quanto uma Indicação Geográfica conferem valor agregado a um produto ou processo, pois são modalidades de proteção intelectual. Como tal, essas modalidades podem ser incorporadas em uma negociação para melhorar a competitividade de determinado setor da economia. Algumas políticas públicas podem regulamentar essas questões com o propósito de melhorar a competitividade, mas é preciso que se observe o impacto dessas estratégias nos negócios brasileiros. Este trabalho apresenta uma discussão a respeito da proteção do produto cachaça no que se refere à indicação geográfica com base no arcabouço legal acerca do tema e sua relação com o registro de marcas. A pesquisa aprofundou-se nos dados quantitativos de pedido para registros de marcas e foi utilizada com objetivo de apresentar a evolução desses registros, no período de 2002 a 2022, com observações sobre deferimento/indeferimento.
