Justiça militar e direitos humanos no Brasil: uma análise da competência para o julgamento de crimes cometidos por militares contra civis a partir dos parâmetros constitucionais e internacionais

Resumo: The Brazilian Military Justice, integrated to the Judicial Power by the Constitution of 1934, works in times of peace and war. The Federal Constitution of 1988 assigns to such jurisdictional branch the competence to judge military crimes defined by law. The Military Penal Code provides that crimes committed by military personnel against civilians in time of peace, regardless of their gravity, constitute matters within the military jurisdiction. However, the constitutional clauses related to the administration of justice (especially those of access to justice and prohibition of judgment by non-competent bodies), as well as the similar norms of human rights treaties approved by Brazil, challenge such attribution, since the composition of the Military Justice of the Union and of the States-Members may lead to a “corporation’s spirit” between judges and defendants. Based on this confrontation, the research will seek to answer the following problem: the jurisdiction of the Brazilian Military Justice for the adjudication of complaints involving crimes committed by the military against civilians is compatible with the international obligations assumed by the Brazilian State in the protective framework of human rights determined by the Federal Constitution of 1988? The importance of the research is revealed by the need to discuss the obligations of the State regarding the conformation of its legislation to the human rights treaties already incorporated, which holds a qualified stature in the domestic legal order. The methodology adopted was the deductive and the consultation of documentary sources (legislation, treaties, reports, sentences, etc.) was prioritized, whose analysis was contextualized from the national and foreign literature. The thesis was divided into four chapters. In the first moment, the measures taken by the Brazilian political bodies to militarize public security in the 2010 years and to publish a normative structure responsible for exempting the military agents from being submitted to the civil control for the crimes practiced by them were discussed; the following chapter contains a review of how the monitoring mechanisms of the United Nations human rights treaties understand the functioning and competence of military courts; in the third chapter, it was analysed the scope of the State’s duty to provide protection and judicial guarantees in scenarios of impunity for crimes perpetrated by the military in the treaties of the inter-American system for the protection of human rights and the interpretation presented about the issue by the Inter-American Commission and Court of Human Rights; finally, the impact of these sources of international human rights law in Brazil was examined and how they could serve as a basis for the partial reform of the jurisdictional military system. It was concluded that the coherent reading of the constitutional block formed by the Federal Constitution of 1988 and the human rights treaties in force in the domestic order demand the necessity to exclude the jurisdiction of the Military Justice for the trial of crimes committed by the military against civilians, given the high probability that such acts constitute serious violations of human rights. Such modification may be carried out by judicial or legislative means.

The importance of the research is revealed by the need to discuss the obligations of the State regarding the conformation of its legislation to the human rights treaties already incorporated, which holds a qualified stature in the domestic legal order. The methodology adopted was the deductive and the consultation of documentary sources (legislation, treaties, reports, sentences, etc.) was prioritized, whose analysis was contextualized from the national and foreign literature. The thesis was divided into four chapters. In the first moment, the measures taken by the Brazilian political bodies to militarize public security in the 2010 years and to publish a normative structure responsible for exempting the military agents from being submitted to the civil control for the crimes practiced by them were discussed; the following chapter contains a review of how the monitoring mechanisms of the United Nations human rights treaties understand the functioning and competence of military courts; in the third chapter, it was analysed the scope of the State’s duty to provide protection and judicial guarantees in scenarios of impunity for crimes perpetrated by the military in the treaties of the inter-American system for the protection of human rights and the interpretation presented about the issue by the Inter-American Commission and Court of Human Rights; finally, the impact of these sources of international human rights law in Brazil was examined and how they could serve as a basis for the partial reform of the jurisdictional military system. It was concluded that the coherent reading of the constitutional block formed by the Federal Constitution of 1988 and the human rights treaties in force in the domestic order demand the necessity to exclude the jurisdiction of the Military Justice for the trial of crimes committed by the military against civilians, given the high probability that such acts constitute serious violations of human rights. Such modification may be carried out by judicial or legislative means.A Justiça Militar brasileira, integrada ao Poder Judiciário pela Constituição de 1934, funciona em tempos de paz e guerra. A Constituição Federal de 1988 atribui a tal ramo jurisdicional a competência para julgar os crimes militares definidos em lei. O Código Penal Militar dispõe que os crimes cometidos por militares contra civis em tempo de paz, a despeito de sua gravidade, configuram matéria de competência do foro castrense. No entanto, as cláusulas constitucionais relacionadas à administração da justiça (em especial as de acesso à justiça e proibição de julgamento por órgãos não competentes), assim como as normas congêneres dos tratados de direitos humanos aprovados pelo Brasil, desafiam tal atribuição, uma vez que a composição da Justiça Militar da União e dos estados-membros pode ensejar um “espírito de corporação” entre juízes e réus. A partir dessa confrontação, a pesquisa buscará responder o seguinte problema: a competência da Justiça Militar brasileira para o julgamento de denúncias envolvendo crimes cometidos por militares contra civis é compatível com as obrigações internacionais assumidas pelo Estado no marco protetivo dos direitos humanos determinado pela Constituição Federal de 1988? A importância da pesquisa revela-se pela necessidade de se discutir as obrigações do Estado no tocante à conformação da sua legislação aos tratados de direitos humanos por si incorporados, os quais detém estatura qualificada na ordem jurídica interna. A metodologia adotada foi a dedutiva e priorizou-se a consulta às fontes documentais (legislação, tratados, relatórios, sentenças etc.), cuja análise foi contextualizada a partir da literatura nacional e estrangeira. A tese foi dividida em quatro capítulos. No primeiro momento, discutiram-se as medidas tomadas pelos órgãos políticos brasileiros no sentido de militarizar a segurança pública nos anos 2010 e editar uma estrutura normativa responsável por isentar os agentes militares de submeterem-se ao controle civil pelos crimes por si praticados; a seguir, analisou-se como os mecanismos de monitoramento dos tratados de direitos humanos da ONU compreendem o funcionamento e a competência das cortes militares; no terceiro capítulo, estudou-se o alcance do dever estatal de ofertar proteção e garantias judiciais em cenários de impunidade por crimes perpetrados por militares presente nos tratados do sistema interamericano de proteção dos direitos humanos e a interpretação apresentada sobre o assunto pela Comissão e Corte Interamericanas; por último, examinou-se o impacto dessas fontes de direito internacional dos direitos humanos no Brasil e como elas podem servir de base para a reforma parcial do sistema de competências jurisdicional militar. Concluiu-se que a leitura coerente do bloco de constitucionalidade formado pela Constituição Federal de 1988 e os tratados de direitos humanos em vigor na ordem doméstica demanda a necessidade de excluirse a competência da Justiça Militar para o julgamento de crimes cometidos pelos militares contra civis, haja vista a alta probabilidade de tais atos constituírem graves violações aos direitos humanos. Tal modificação pode ser realizada pelas vias jurisdicional ou legislativa.La justice militaire brésilienne, intégrée au pouvoir judiciaire par la Constitution de 1934, travaille en temps de paix et de guerre. La Constitution fédérale de 1988 attribue à cette branche juridictionnelle le pouvoir de juger les crimes militaires définis par la loi. Le Code pénal militaire prévoit que les crimes commis par des militaires contre des civils en temps de paix, quelle que soit leur gravité, relèvent de la juridiction militaire. Toutefois, les clauses constitutionnelles relatives à l'administration de la justice (notamment celles relatives à l'accès à la justice et à l'interdiction de jugement par des organes non compétents), ainsi que les normes similaires des traités relatifs aux droits de l'homme approuvés par le Brésil contestent cette attribution, du fait que la composition. de la justice militaire de l'Union et des États membres puisse conduire à un "esprit de corporation" entre juges et accusés. Sur la base de cette confrontation, la recherche visera à résoudre le problème suivant: la compétence de la justice militaire brésilienne pour le jugement des plaintes pour crimes commis par des militaires contre des civils est compatible avec les obligations internationales assumées par l'État brésilien dans le cadre de protection des droits de l'homme définis par la Constitution fédérale de 1988? L’importance de la recherche est révélée par la nécessité de discuter des obligations de l’État en ce qui concerne la conformité de sa législation aux traités relatifs aux droits de l’homme déjà incorporés, qui ont une stature qualifiée dans l’ordre juridique national. La méthodologie adoptée consistait à déduire et à prioriser l’analyse auprès des sources documentaires (législation, traités, rapports, sentence, etc.), dont l'analyse était contextualisée à partir de la littérature nationale et étrangère. La thèse a été divisée en quatre chapitres. Dans un premier temps, les mesures prises par les instances politiques brésiliennes pour militariser la sécurité publique au cours des années 2010 et pour publier une structure normative chargée de dispenser les agents militaires de leur soumission au contrôle civil pour les crimes commis par ceux-ci ont été discutées; Ce qui suit est un examen de la manière dont les mécanismes de surveillance des traités des droits de l'homme des Nations Unies comprennent le fonctionnement et la compétence des tribunaux militaires; dans le troisième chapitre, nous avons analysé l'étendue de l'obligation incombant à l'État de fournir une protection et des garanties judiciaires en cas d'impunité pour les crimes perpétrés par des militaires dans les traités du système interaméricain de protection des droits de la personne et l'interprétation présentée par la Commission interaméricaine et la Cour des droits de l'homme; enfin, l'impact de ces sources du droit international des droits de l'homme au Brésil a été examiné et comment elles pourraient servir de base à la réforme partielle du système de compétence juridictionnel militaire. Il a été conclu que la lecture cohérente du bloc de constitutionnalité formé par la Constitution fédérale de 1988 et les traités relatifs aux droits de l'homme en vigueur dans l'ordre interne imposait d'exclure la compétence de la justice militaire pour le jugement des crimes commis par des militaires contre civils, étant donné la probabilité élevée que de tels actes constituent de graves violations des droits de l'homme.
