Resumo: The study presented here demonstrates an analysis of the demarcation of indigenous lands and their correlation with Latin American constitutionalism. The present work intends to present the concepts involved, the legislative history, as well as to establish a necessary relation between the problematic indigenous environmental question and the environmental protection defended by this new constitutionalism. The method used is the analytical-hermeneutic, in which, through bibliographical and documentary research will be made the scientific examination of the problem presented. It can be concluded, from the above, that Latin American constitutionalism comes under the protection and serves as justification for the indigenous lands to be properly demarcated in Brazil.
