Resumo: | Although it is increasingly common to find, among the most specialised doctrine, those who defend the recognition of binding legal obligations to companies in the field of human rights, the debate remains highly polarised. Positioning ourselves within the framework of theories on global governance, in these pages, we will defend the pragmatism of the Ruggie Principles and their convenient complementarity with a future international treaty. Now, if on the one hand we understand that the development and implementation of the United Nations Principles must proceed through the reinforcement of a victim-based approach, on the other hand we believe that the contours of a future international treaty will have to be delimited with an adequate degree of technical precision, as with a sufficient level of generality and abstraction. So in this sense, proposals to reform the so-called Draft 0 of the future international treaty on companies and rights will be formulated. |

So in this sense, proposals to reform the so-called Draft 0 of the future international treaty on companies and rights will be formulated.Aunque cada vez es más habitual encontrar, entre la doctrina más especializada, a quienes defienden el reconocimiento de obligaciones jurídicas vinculantes a las empresas en materia de derechos humanos, el debate sigue estando muy polarizado. Situándonos en el marco de las teorizaciones sobre la gobernanza global, en estas páginas defenderemos el pragmatismo de los Principios Ruggie y su conveniente complementariedad con un futuro tratado internacional. Ahora bien, si por un lado entendemos que el desarrollo e implementación de los Principios de Naciones Unidas debe proceder mediante el refuerzo de un enfoque basado en las víctimas, por otro consideramos que los contornos de un futuro tratado internacional habrán de delimitarse tanto con un adecuado grado de precisión técnica, como con un suficiente nivel de generalidad y abstracción. Y en este sentido se formularán, para finalizar, algunas propuestas de reforma del llamado Draft 0 del futuro tratado internacional sobre empresas y derechos.Embora seja cada vez mais comum encontrar, entre a doutrina mais especializada, aqueles que defendem o reconhecimento de obrigações legais obrigatórias para as empresas no que diz respeito aos direitos humanos, o debate permanece altamente polarizado. Colocando-nos no quadro das teorizações sobre governação global, nestas páginas defenderemos o pragmatismo dos Princípios de Ruggie e a sua conveniente complementaridade com um futuro tratado internacional. No entanto, se por um lado entendemos que o desenvolvimento e a implementação dos Princípios das Nações Unidas devem prosseguir através do reforço de uma abordagem baseada na vítima, por outro consideramos que os contornos de um futuro tratado internacional terão que ser delimitados tanto com um grau adequado de precisão técnica como com um nível suficiente de generalidade e abstracção.
