BIC Companies in Colombia: a light in the implementation of the Interamerican Standards in Human Rights and Business

Resumo: | Since the 1990s, Latin American countries have been conditioned to the neoliberal economic dynamics that radiate all spheres of these societies and that, thanks to the phenomenon of globalization, the gaps between countries of the "North" and the South have deepened ". In this context, the countries of the region face different socio-political, economic, and cultural problems on a daily basis that hinder the guarantee and protection of human rights, particularly when these prerogatives are threatened or violated by “private actors”, more specifically, by companies. However, today there is a little light to improve this situation in Latin American countries, which is promoted by the Inter-American System for the protection of Human Rights: the recommendations of the REDESCA report on Business and Human Rights, which highlights the need to strengthen liability regimes within each state, as well as to promote initiatives that favor companies that are socially responsible and respectful of human rights and the environment. Thus, this article presents an example that may mean a change in Colombia from the structure and purpose of commercial companies, that is, the so-called “BIC Companies”, which propose a break with the neoliberal paradigm by promoting a new generation of companies that report benefits for society and the environment, beyond the economic interest of their shareholders. |

En tal contexto, los países de la región diariamente se enfrentan a diferentes problemáticas de carácter sociopolítico, económico y cultural que obstaculizan la garantía y protección de los derechos humanos, en particular, cuando estas prerrogativas se ven amenazadas o vulneradas por “actores privados”, más concretamente, por las empresas. Empero, hoy existe una pequeña luz para mejorar esta situación en los países latinoamericanos, que se impulsa desde el Sistema Interamericano de protección de los Derechos Humanos: las recomendaciones del informe de REDESCA sobre Empresas y Derechos Humanos; que resalta la necesidad de fortalecer los regímenes de responsabilidad al interior de cada estado, así como de promover iniciativas que favorezcan a las empresas socialmente responsables y respetuosas de los derechos humanos y del medio ambiente. Así, en este artículo se presenta un ejemplo que puede significar un cambio en Colombia desde la estructura y finalidad de sociedades comerciales, esto es, las llamadas “Empresas BIC”, que proponen una ruptura del paradigma neoliberal al impulsar una nueva generación de empresas que reporten beneficios para la sociedad y el medio ambiente, más allá del interés económico de sus accionistas.Desde a década de 1990, os países latino-americanos estão condicionados às dinâmicas econômicas neoliberais que irradiam todos os âmbitos dessas sociedades e que graças ao fenômeno da globalização, as brechas entre os países do "Norte" e do "Sul" se aprofundaram. Neste contexto, os países da região enfrentam diariamente diversos problemas sociopolíticos, econômicos e culturais que dificultam a garantia e proteção dos direitos humanos, principalmente quando essas prerrogativas são ameaçadas ou violadas por “atores privados” mais especificamente, por empresas. No entanto, hoje há pouca luz para melhorar esta situação nos países latino-americanos, o que é promovido pelo Sistema Interamericano de Proteção dos Direitos Humanos: as recomendações do relatório da REDESCA sobre Empresas e Direitos Humanos, que destaca a necessidade de fortalecer os regimes de responsabilidade em cada estado, bem como de promover iniciativas que favoreçam as empresas socialmente responsáveis e que respeitem os direitos humanos e o meio ambiente.
