A situação jurídica do abandono afetivo na legalidade civil-constitucional

Resumo: O presente artigo tem por escopo desenvolver uma linhagem civil-constitucional acerca do tema abandono afetivo e entender como os Tribunais Brasileiros vem adotando o instituto. É sedimentado no ordenamento pátrio que a indenização de cunho pecuniário não atinge o resultado almejado, sendo preponderante uma reanalise do tema, mediante o estudo de medidas alternativas que possam alcançar o objetivo pretendido que é restabelecer o vínculo paterno-filial, assegurando aos menores a proteção Constitucional. O tema em estudo, em vista da ausência de regulação positivada, encontra percalços e dificuldades em ser definido e indenizado, devendo dessa forma, ser compreendido como uma situação subjetiva complexa, que merece o subjetivismo oriundo dos Direitos de Personalidade. Há de se mensurar a importância em conferir as crianças e aos adolescentes um crescimento sadio, pautado nos princípios constitucionais, principalmente, na Dignidade da Pessoa humana, que servirão de alicerce para a construção de um entendimento humanizado e efetivo do judiciário, logo de uma sociedade que preconiza a paz social.

Country law maintains that pecuniary compensation does not achieve the desired result, and a reanalysis of the subject is critical. Studying alternative methods can achieve the intended outcome, which is to reestablish the parental bond and ensure constitutional protection to minors. In light of the absence of positive regulation, the subject under study encounters difficulty being able to be defined and indemnified, and therefore must be understood as a complex, independent situation that deserves the subjectivism derived from the Rights of Personality.
