Resumo: This monograph goal is to analyze the possibility of using evidence of murder felonies, collected through the Serendipity Phenomenon, acquired by using phone tapping, during criminal investigations or criminal persecutions focusing on other crimes. It turns out that the Brazilian legal system does not define this concept clearly, because the teaching has diferences while regarding this subject. Furthermore, it’s necessary to verify this action legitimacy, as well if its application respects the constitutional law, especially the right of defense and contractory. Despite this, it’s also necessary to analyze the rules related to the subject, the peculiarities of each case and check the precedents of all those that coincides within the theme of this work

Ocorre que o ordenamento jurídico brasileiro não define tal conceito, assim como a doutrina possui divergências no tocante a este assunto. Outrossim, é necessário verificar a legalidade de tal ato, assim como se sua aplicação respeita os direitos e garantias fundamentais, principalmente a ampla defesa e o contraditório.
