The staggered system of effective punishment has repercussions in several obstacles that affect its effectiveness. Thus, given the social and political relevance of the theme, it is necessary to analyze the issues related to the Brazilian prison system and, specifically, the causes that causethe ineffective application of the progressive system of execution of sentence. Thus, the present study examined the subject using deductive approach, monographic procedure and bibliographic and documentary research techniques. Initially, after doctrinal appreciation, the functions of the pen and its historical evolution were addressed. In addition, the regimes of execution of sentence and the possibility of regression and progression of these were evaluated. Finally, with the use of doctrine, together with the informative report of the National Secretariat of Penal Policies, some of the causes that generate the ineffective application of the progressive system of execution of the sentence were observed. Therefore, in view of the points addressed and treated during the work, the notorious public interference is concluded, since the prison system lacks investments by government authorities and effective resocialization programs for inmates.
