Resumo: | The present text analyzes the role of the State in guaranteeing the right to education of inmates at the Centro Socio-Educativo Educacional Edson Mota/CSE, João Pessoa - PB. Its object of study is the investigation into the conditions of provision of education for inmate adolescents in the aforementioned socio-educational unit. Its general objective is to analyze how FUNDAC- PB implements education for adolescents based on the educational public policies contained in the Child and Adolescent Rights Guarantee System, the National Socio-Educational Assistance System, the State Socio-Educational Assistance Plan of Paraíba and in the Operational Guidelines of State Schools for adolescents. The thesis presented is that the units for the execution of socio-educational measures in Paraíba do not have a program for the execution of public educational policies related to inmate adolescents or do not guarantee the proper execution of these policies. The question that guided the research was the following: to what extent does the State guarantee the right to education of adolescents in the context of socio- educational measures through an emancipatory education that constitutes a means for the acquisition of other rights? In order to respond to the formulated problem, the thesis was structured in four chapters, in addition to the introduction and conclusion. In the first chapter, we present the methodological course of the research, explaining the method and the set of instruments, procedures and techniques for data collection and analysis. In the second chapter, we carry out a theoretical and conceptual survey about the definition of children and adolescents as different stages of life in Brazil and a brief study about the social history of children and adolescents until they are recognized as subjects of rights. In the third chapter, we discuss a little about how the construction of rights for children and adolescents in Brazil took place, studying the national and international legislation regarding the matter. In the fourth and last chapter we present the data related to the empirical research. To this end, we carried out a survey of the documents that guide the education of adolescents who are in the context of compliance with socio-educational measures, as well as a discussion about the Escola da Escolha model, which was selected as the basis for the implementation of ECIS in Paraiba. Having carried out this survey, we set out to discuss the Socio-Educational Center Edson Mota and the Escola Cidadã Integral Socio-educativa Almirante Saldanha (EAS) through an analysis of their basic documents, namely the Internal Regulations and the respective Pedagogical Political Projects. Finally, we carried out a field survey throughout the year 2022 with visits to the EAS in order to observe how education is offered to adolescents who are interns at the CSE. As a main result, we find that the Escola Cidadã Integral Socioeducativa Almirante Saldanha provides an adequate teaching model, based on an emancipatory education, but that the purpose of this education does not reach all adolescents due, mainly, but not exclusively, to the constant changes that occur throughout the school year and day to day at the unit. Some challenges arose throughout the work undertaken, among which we can highlight the logistics of transferring teenagers from their rooms to the classrooms, the search for guaranteed class time following the entry and exit times and the fight for the creation of a teaching routine even in the face of the constant changes that are present in the daily life of the CSE with the changes in class schedules and the constant arrival and departure of adolescents. We intend to continue investigating the guarantee of the right to education for these adolescents. |

El presente texto analiza el papel del Estado en la garantía del derecho a la educación de los internos del Centro Socio-Educativo Educacional Edson Mota/CSE, João Pessoa - PB. Tiene como objeto de estudio la indagación sobre las condiciones de prestación de la educación de los adolescentes internos en la referida unidad socioeducativa. Tiene como objetivo general analizar cómo FUNDAC-PB implementa la educación de los adolescentes a partir de las políticas públicas educativas contenidas en el Sistema de Garantía de los Derechos del Niño y del Adolescente, el Sistema Nacional de Atención Socioeducativa, el Plan Estatal de Atención Socioeducativa de Paraíba. La tesis presentada es que las unidades para la ejecución de medidas socioeducativas en Paraíba no tienen un programa para la ejecución de políticas públicas educativas relacionadas con los adolescentes internos o no garantizan la correcta ejecución de estas políticas. La pregunta que guió la investigación fue la siguiente: ¿En qué medida el Estado garantiza el derecho a la educación de los adolescentes en el marco de las medidas socioeducativas a través de una educación emancipatoria que constituye un medio para la adquisición de otros derechos? Para dar respuesta al problema formulado, la tesis se estructuró en cuatro capítulos, además de la introducción y la conclusión. En el primer capítulo, presentamos el recorrido metodológico de la investigación, explicando el método y el conjunto de instrumentos, procedimientos y técnicas para la recolección y análisis de datos. En el segundo capítulo, realizamos un recorrido teórico y conceptual sobre la definición de niños y adolescentes como diferentes etapas de la vida en Brasil y un breve estudio sobre la historia social de los niños y adolescentes hasta que son reconocidos como sujetos de derechos. En el tercer capítulo, discutimos un poco sobre cómo se dio la construcción de los derechos de los niños y adolescentes en Brasil, estudiando la legislación nacional e internacional en la materia. En el cuarto y último capítulo presentamos los datos relacionados con la investigación empírica. Para ello, realizamos un levantamiento de los documentos que orientan la educación de adolescentes que se encuentran en contexto de cumplimiento de medidas socioeducativas, así como una discusión sobre el modelo Escola da Escolha, que fue seleccionado como base para la implementación de las ICE en Paraíba. Realizado este levantamiento, nos propusimos discutir el Centro Socioeducativo Edson Mota y la Escola Cidadã Integral Socioeducativa Almirante Saldanha (EAS) a través del análisis de sus documentos básicos, a saber, el Reglamento Interno y los respectivos Proyectos Políticos Pedagógicos. Finalmente, realizamos un relevamiento de campo a lo largo del año 2022 con visitas a las EAS con el fin de observar cómo se brinda educación a los adolescentes que se encuentran en prácticas en el CSE. Como resultado principal, encontramos que la Escola Cidadã Integral Socioeducativa Almirante Saldanha brinda un modelo de enseñanza adecuado, basado en una educación emancipadora, pero que el propósito de esta educación no alcanza a todos los adolescentes debido, principalmente, pero no exclusivamente, a la constante cambios que ocurren a lo largo del año escolar y día a día en la unidad. A lo largo del trabajo emprendido surgieron algunos desafíos, entre los que se pueden destacar la logística de traslado de los adolescentes de sus habitaciones a las aulas, la búsqueda de garantías horarias de clase siguiendo los horarios de entrada y salida y la lucha por la creación de una rutina didáctica incluso en los ante los constantes cambios que se presentan en el día a día del CSE con los cambios en los horarios de clases y la constante entrada y salida de adolescentes. Tem como objeto de estudo a investigação sobre as condições de oferta da educação para os adolescentes internos na referida unidade socioeducativa. Seu objetivo geral é analisar como a FUNDAC-PB implementa a educação para os adolescentes com base nas políticas públicas educacionais que constam no Sistema de Garantia de Direitos da Criança e do Adolescente, no Sistema Nacional de Atendimento Socioeducativo, no Plano Estadual de Atendimento Socioeducativo da Paraíba e nas Diretrizes Operacionais das Escolas Estaduais para os adolescentes. A tese apresentada é a de que as unidades de execução de medidas socioeducativas da Paraíba não possuem um programa de execução de políticas públicas educacionais relativas aos adolescentes internos ou não garantem a devida execução dessas políticas. A questão que norteou a pesquisa foi a seguinte: em que medida o Estado garante o direito à educação do adolescente em contexto de medida socioeducativa através de uma educação emancipadora que constitua meio para aquisição de outros direitos? A fim de responder ao problema formulado, a tese se estruturou em quatro capítulos, além da introdução e da conclusão. No primeiro capítulo apresentamos o percurso metodológico da pesquisa explicitando o método e o conjunto de instrumentos, procedimentos e técnicas de coleta e de análise dos dados. No segundo capítulo, realizamos um levantamento teórico conceitual acerca da definição de criança e adolescente como fases distintas da vida no Brasil e um breve estudo acerca da história social da criança e do adolescente até serem reconhecidos como sujeitos de direitos. No terceiro capítulo abordamos um pouco sobre como se deu a construção de direitos para crianças e adolescentes no Brasil, estudando a legislação nacional e internacional a respeito da matéria. No quarto e último capítulo apresentamos os dados relativos à pesquisa empírica. Para tanto, realizamos um levantamento acerca dos documentos que norteiam a educação de adolescentes que se encontram em contexto de cumprimento de medida socioeducativas, bem como uma discussão acerca do modelo de Escola da Escolha, que foi selecionado como base para a implantação das ECIs na Paraíba. Realizado esse levantamento, partimos para discorrer sobre o Centro Socioeducativo Edson Mota e a Escola Cidadã Integral Socioeducativa Almirante Saldanha (EAS) através de uma análise sobre os seus documentos de base, quais sejam os Regimentos Internos e respectivos Projetos Político Pedagógicos. Por fim, realizamos uma pesquisa de campo ao longo do ano de 2022 com visitas à EAS com finalidade de observar como se dá a oferta da educação para os adolescentes que se encontram internos no CSE. Como principal resultado temos a constatação de que a Escola Cidadã Integral Socioeducativa Almirante Saldanha disponibiliza um modelo de ensino adequado, baseado em uma educação emancipadora, mas que a finalidade dessa educação não atinge todos os adolescentes em virtude, principalmente, mas não exclusivamente, das constantes mudanças que ocorrem ao longo do ano letivo e do dia a dia da unidade. Alguns desafios se colocaram ao longo de todo o trabalho empreendido, dentre os quais podemos destacar a logística de traslado dos adolescentes dos seus quartos para as salas de aula, a busca pela garantia do tempo de aula seguindo os horários de entrada e saída e a luta pela criação de uma rotina de ensino mesmo diante das constantes mudanças que se apresentam no cotidiano do CSE com as mudanças de horário das aulas e a constante entrada e saída de adolescentes.
