O reconhecimento jurídico do poliamor como multiconjugalidade consensual e estrutura familiar

Resumo: This PhD thesis aims at examining the viability of legitimating and protecting polyamorous relationships as affective-families that diverge from the conventional pattern of the monogamous conjugal family. This study is linked to the Human Righs and to the Family Law. The question is: can polyamory be legally recognized as a multiconjugality and a family structure in the Brazilian order? In a deductive way, starting from general premises of family, conjugality, monogamy and Law, polyamory is seen as a relational archetype that emerges in the contemporary standards, which is marked by diversity and multiplicity – of identities, relationships, emotional ties, parenting and family arrangements. Given that, through the extensive bibliographic and documentary sources, including ethnographic studies, participation in scientific events and interdisciplinary research groups, the hypothesis on the viability of legal recognition is confirmed as positive whether due to the constitutional principles of human dignity, affectivity, family plurality, equality, respect to the differences, to the freedom of family formation and to the State's minimal intervention in private autonomy, or to the presence of common elements of any family under legal terms: blood or socio-affective ties, stability, public and ostensible coexistence and intuitu familiae. Furthermore, the observation of the behaviour of polyamory practitioners in the virtual environment and the analysis of the Brazilian reality that has already registered those types of union were also relevant to the research. The perspective of multiconjugality entails the idea of polyamorous relationships that form multiple consensual conjugalities that are consensual, stable, concomitant and integrated in the same family nucleus, configured as a stable polyamorous or poliaffective union, which represents a relational category unlike marriage, stable monogamous unions and concubine or parallel relations. The monogamous order that rules conjugal relationships needs to be reconsidered due to the polyamorous non-monogamous relationships led by the consensus of all parties involved. In the context, the complexities emerged from this sort of relationship, affections and responsibilities require specific normative regulation in order to provide adequate protection and legal certainty.

La présente recherche est liée aux Droits de l'homme et au Droit de la Famille. La problématique de recherche se traduit par la question suivante: le polyamour peut-il être juridiquement reconnu comme une multiconjugalité et une structure familiale dans le système brésilien? De façon déductive, à partir des prémisses générales de la famille, de la conjugalité, de la monogamie et du Droit qui les entoure, les particularités du polyamour sont discutées en tant qu’un archétype relationnel qui émerge dans la contemporanéité marquée par la diversité et par la multiplicité – d’identités, de relations, de liens affectifs, de parentalités et d’arrangements familiaux. Dans ce contexte, avec un large soutien des sources bibliographiques et documentaires consultées, y compris les études ethnographiques déjà réalisées, la participation à des événements scientifiques et à des groupes de recherche interdisciplinaires, l'observation du comportement des adeptes du polyamour dans le milieu virtuel et l'analyse de la réalité brésilienne qui compte déjà avec des enregistrements, chez le notaire, de ces types d'union, l'hypothèse confirme de façon positive cette possibilité de reconnaissance juridique, que ce soit en raison des principes constitutionnels de dignité humaine, d'affectivité, de pluralité de formes familiales, d'égalité, de respect aux différences, de la liberté de formation familiale et d'intervention minimale de l'État dans l'autonomie privée, ou soit par la présence d'éléments communs dans toute famille réglementée par le Droit: des liens de sang et / ou socio-affectifs, stabilité, coexistence publique et intuitu familiae. La perspective de multiconjugalité conçue dans la thèse comprend l'idée de relations polyamoureuses comprenant des conjugalités multiples consensuelles, stables, concomitantes et intégrées dans le même noyau familial, configurées comme une union stable polyamoureuse ou polyaffective, représentant une catégorie de relation différente du mariage, de l’union monogame stable et des relations concubines ou parallèles sous la législation actuelle. L'ordre monogamique qui régit les relations conjugales mérite d'être repensé avant les relations nonmonogames polyamoures guidées par le consensus de toutes les parties impliquées, et les complexités découlant de cet imbrication de vies, d'affections et de responsabilités exigent une réglementation normative spécifique qui peut offrir une protection adéquate et une sécurité juridique.Coordenação de Aperfeiçoamento de Pessoal de Nível Superior - CAPESA tese visa a perscrutar, pelo viés jurídico, a viabilidade de legitimação e de tutela do poliamor como relacionamento afetivo-familiar, divergente do padrão convencional da família conjugal monogâmica. A investigação vincula-se aos Direitos Humanos e ao Direito de Família. A problemática da pesquisa traduz-se na seguinte indagação: o poliamor pode ser reconhecido juridicamente como uma multiconjugalidade e uma estrutura familiar no ordenamento brasileiro? De forma dedutiva, partindo das premissas gerais da família, da conjugalidade, da monogamia e do Direito que as circunda, são abordadas as particularidades do poliamor enquanto arquétipo relacional que emerge na contemporaneidade marcada pela diversidade e pela multiplicidade – de identidades, relacionamentos, vínculos afetivos, parentalidades e arranjos familiares. Nesse contexto, com lastro nas amplas fontes bibliográficas e documentais pesquisadas, que incluem estudos etnográficos já realizados, participação em eventos científicos e em grupos de pesquisa interdisciplinares, observação do comportamento dos praticantes do poliamor no meio virtual e análise da realidade brasileira que já conta com registros cartorários dessas formas de união, confirma-se a hipótese positiva no sentido da possibilidade do reconhecimento jurídico em questão, seja em razão dos princípios constitucionais da dignidade da pessoa humana, da afetividade, da pluralidade das formas de família, da igualdade, do respeito às diferenças, da liberdade de formação familiar e da intervenção mínima do Estado na autonomia privada, seja pela presença dos elementos comuns a qualquer família regulada pelo Direito: laços sanguíneos e/ou socioafetivos, estabilidade, convivência pública e ostensiva e intuitu familiae. A perspectiva da multiconjugalidade concebida na tese concerne à ideia das relações poliamorosas que formam conjugalidades múltiplas consentidas, estáveis, concomitantes e integradas em um mesmo núcleo familiar, configuradas como uma união estável poliamorosa ou poliafetiva, que representa uma categoria relacional diferente do casamento, da união estável monogâmica e das relações concubinárias ou paralelas nos termos da legislação vigente.
