Defesa: Curitiba, 02/09/2016Inclui referências : f. 223-245Resumo: A presente tese possui como objetivo central aproximar o "processo civil dos livros" do "processo civil da realidade", problematizando suas certezas teóricas. Com esse propósito, o seu percurso vai da desconstrução a uma proposta de reconstrução: para permitir o primeiro passo, apresenta-se uma abordagem aqui descrita como "ceticismo moderado"; para alcançar o segundo, traz-se como guia interpretativa a análise "panprocessual". Procurando desempenhar essa tarefa, o estudo tem sua estrutura dividida em quatro momentos: (i) no primeiro, observamos o "estado de arte" do processo civil brasileiro, identificando suas reformas e seus discursos mais marcantes. Concluímos, aqui, que ele se encontra em um contínuo movimento entre seus meios e seus resultados; (ii) no segundo, apresentamos o "ceticismo moderado", descrevendo seus principais elementos e os articulando com a natureza cultural (e flexível) da resolução de disputas. Com isso, percebemos que não há um "processo (absolutamente) correto" e que a disciplina é contextualmente forjada; (iii) no terceiro, utilizamos essa abordagem "cética" para apresentar alguns traços essenciais do processo civil, enfatizando sua lógica representativa, pública e autoritária. Diante disso, sublinhamos também alguns dos seus limites essenciais; (iv) por fim, no quarto, partimos das premissas anteriores para apresentar a mentalidade "panprocessual", expondo seus impactos sobre temas como o "acesso à justiça" e os "direitos processuais". Procura-se, assim, estabelecer uma nova contribuição ao estudo do processo - trazendo novas perspectivas para sua análise. . Palavras Chave: Processo Civil; Ceticismo Moderado; Panprocessualismo.Abstract: The main objective of this dissertation is to bring the 'academic civil procedure' close to the 'real civil procedure', questioning its theoretical certainties. In this sense, its path starts with a deconstructive criticism and arrives at a reconstructive proposal: to allow the first step, I introduce an approach here described as 'soft skepticism'; to reach the second, I present the 'pan-procedural' analysis as an interpretative guide. In order to achieve this goal, the dissertation is composed of four parts: (i) in the first, I describe the Brazilian civil procedure's 'state of art', identifying its reforms and its most remarkable investigations. I conclude, here, that the discipline is in a continuous movement between its means and its results; (ii) in the second, I present the 'soft skepticism', describing its main elements and associating them with the cultural (and flexible) nature of dispute resolution. By doing this, I defend that there is no such thing as an ' (absolutely) correct procedure', and that the discipline is contextually determined; (iii) in the third, I use this 'skeptical' approach to present some essential faces of civil procedure, highlighting that its mentality is representative, public and authoritarian. After that, I also stress some of its essential limits; (iv) finally, in the fourth, I use this theoretical framework to introduce the 'pan-procedural' approach, observing its impacts on issues like the 'access to justice' and the 'procedural rights'. By doing this, I intend to bring a new contribution to the study of civil procedure - providing new perspectives to it.
