Para tanto, lança um breve e necessário olhar sobre a doutrina alienígena, especialmente a alemã, que contemporaneamente construiu uma teorética dos direitos fundamentais, inclusive, sociais, calcada sobretudo nos posicionamentos da Corte Constitucional, e que tem grande impacto na dogmática constitucional luso-brasileira, influenciando, sobremaneira, a jurisprudência nacional. Pode-se observar, que o constituinte pátrio foi notadamente progressista ao positivar os direitos sociais, incluindo-o no catálogo dos direitos fundamentais, consagrando o direito à saúde no artigo 6°, e fora do catálogo, nos artigos 196 a 200 da Constituição Federal. A par dessa iniciativa, inovou também ao insculpir no artigo 5°, § 1°, uma regra principiológica de maximização da eficácia dos direitos fundamentais sociais, ao determinar a aplicabilidade imediata de tais normas, e ao mesmo tempo, um mandado de otimização e vinculação dos poderes públicos à sua concretização. Ver-se-á, assim, que o direito à saúde, enquanto direito fundamental social, possui dupla dimensão: é direito subjetivo individual e direito objetivo da coletividade, oponível em face do Estado, que não pode negar-se a efetivá-lo, nem mesmo arrimado na cláusula limitadora da reserva do financeiramente possível, em homenagem ao princípio informador do Estado Democrático brasileiro da dignidade humana. Sendo ainda relevante constatar, que o postulado da proibição do retrocesso social impede que o direito à saúde já realizado seja aniquilado ou mitigado, ao ponto de ferir o seu núcleo essencial consagrado constitucionalmente. Por derradeiro, constatar-se-á a evolução da nossa jurisprudência, especialmente das Cortes Superiores, que tem reconhecido o caráter subjetivo do direito fundamental à saúde, admitindo a sua justiciabilidade.Abstract: This piece of work proposes to analyse the right to health. Shaped in the 1988 Federal Constitution as a fundamental social right. With this launches a brief and necessary look About a foreign doctrine especially the German doctrine, that contemporaneously constructed a theoretic of the fundamental rights, including social, fitted mainly on the positions of the Constitutional Court, and that has a great impact on the pragmatic Luso- Brazilian, influenced greatly the national jurisprudence. You can observe, that the paternal Constituent was notedly progressive affirming the social rights, including it in the fundamental rights catalogue, rendering the right to health in the 6th article and out of the catalogue, in the 196th 200th articles o f the Federal Constitution. Having knowledge of this initiative also innovated and inscribed in the 5th and 1st articles, a rule based on the fundamentals of principles, maximizing the efficiency of the fundamental social rights, determining an immediate applicability of such rules, and at the same time, a mandate to accelerate the process and the link of the public authorities and its realization. Seeing it as so, the right to health as a fundamental social right, possess a double dimension: a subjunctive individual and objective right o f the society that can be the opposite in the face of the State, that can not be denied to accomplish not even supported in the limited clause of the possible financial reserve, in respect to the fundamental informer of Brazilian Democratic State of the human dignity. Being relevant to establish that what is seen as right and correct prohibites the social retardation preventing that the right to health already accomplished is not defeated or mitigated, to the point of harming its essential nucleus acclaimed constitutionally.
