Resumo: Technology presents itself as an indelible feature of current times, causing changes in the way human beings interact with the world. The most diverse fields of life were modified by digital innovations, which also generated reflexes in Law. Given this scenario, this academic work seeks to analyze the importance of preserving the chain of custody of digital evidence, portraying the role of technical expertise in maintaining fundamental guarantees, deepening the concept and procedures of the chain of custody of electronic devices. Through an interdisciplinary view, the objective is to unveil the procedures performed by the forensic expertise, which currently occupy a prominent place in obtaining evidence. The aim of this research is to demonstrate that it is necessary to find an intersection between new technologies, criminal proceedings and fundamental guarantees. Therefore, it is a study about the chain of custody of digital evidence and its consequences in the criminal process under the light of what is foreseen in the 1988 Constitution

As mais diversas searas da vida foram modificadas pelas inovações digitais, o que gerou reflexos também no Direito. Diante desse cenário, o presente trabalho acadêmico busca analisar a importância da preservação da cadeia de custódia das provas digitais, retratando o papel da perícia técnica para manutenção das garantias fundamentais, aprofundando-se no conceito e nos procedimentos da cadeia de custódia dos dispositivos eletrônicos. Através de uma visão interdisciplinar, objetiva-se descortinar os procedimentos realizados pela perícia forense, que atualmente ocupam lugar de destaque na obtenção das provas. Busca-se com a presente pesquisa demonstrar que é preciso encontrar uma intersecção entre as novas tecnologias, o processo penal e as garantias fundamentais.
