Resumo: This article aims to analyze the right to sexual and gender diversisty based on a comparative study of human rights protection systems at global and inter-American levels. It intends to answer the question regarding the possibility of a complementary dialogue between the systems for greater effectiveness in protecting human rights at the international level. For that, the qualitative method is applied with literature review, as well as document research about conference reports and resolutions on the subject, using the path since the entry into the agenda of international systems. Therefore, when using the expression of gender and sexuality, it is considered that the global system, which provides universal treatment to human rights, and the inter-American system, wich is geographically restricted to a location with its peculiarities, can interact simultaneously an complementary way to ensure a multilevel protection of individuals.

Tiene la intención de responder al problema que concierne a la posibilidad de un diálogo complementario entre los sistemas para una mayor efectividade en la protección de los derechos humanos a nivel internacional. Para eso se emplea el método cualitativo, con el uso de revisión de la literatura así como investigación documental sobre informes de congresos y resoluciones sobre el tema, utilizando la ruta desde el principio de la entrada en la agenda de los sistemas internacionales. Así, al utilizar la expresión de género y sexualidad, se considera que el sistema global, que brinda tratamiento universal a los derechos humanos, y el sistema interamericano, geográficamente restringido a unlugas con sus peculiaridades, puede interactuar para actuar de manera simultánea y complementaria en una protección multinivel de las personas.O presente artigo tem por objetivo analisar o direito à diversidade sexual e de gênero a partir de um estudo comparativo dos sistemas de proteção dos direitos humanos a nível global e interamericano. Pretende-se responder à problemática que diz respeito à possibilidade de um diálogo complementar entre os sistemas para maior eficácia na proteção de direitos humanos a nível internacional. Para tanto, é empregado o método qualitativo, com o uso de revisão bibliográfica bem como de pesquisa documental sobre relatórios de conferências e resoluções acerca da temática, utilizando o caminho desde o início da entrada na agenda dos sistemas internacionais.
