REFUGE’S PATHS: AN OVERVIEW OF THE BRAZILIAN REFUGE POLICY’S DECISION FLOW BETWEEN 1990 AND 2019

This work stars from the following research question: how has the Brazilian refuge policy’s decision flow worked when it comes to effectiveness in answering its requesters? As the main goal, it analyzes how (in)effective said policy is regarding reception/denial of refuge’s requests in the country. As specific goals, first the paper describes the juridical and structural refuge system, focusing on its grounds being international humanitarian law and human rights. Then, the data made available by the Justice and Public Security Ministry is discussed, once it discloses information about the requests and their decisions between 1990 and 2019. The volume, waiting time, reasoning behind eventual denials and proportion between inputs and outputs were considered. As methodology, a triangulation was made using literature review, documents’ and contents’ analysis to quantitatively and qualitatively evaluate the official data in the period. The conclusion is that there is considerable ineffectiveness in such response, on account of the slow response time, big number of denials and shelvings; and, mainly, inconsistencies regarding this policy’s public data.
