DIRECT DEMOCRACY AND THE PROTECTION OF THE MINORITY RIGHTS: OBSERVATIONS ON THE THESIS OF THE TYRANNY OF THE MAJORITY

Resumo: This article tackles the topic of direct democracy and the discussion of its dysfunctional use reflected on the attack on the rights of social minorities. The popular initiatives and consultations often aim to block or neutralize the security of rights to groups of the society such as indigenous people (or native people), immigrants, women, racial minorities, homosexuals, etc. In this way, it is argued that the risk of popular manifestation may culminate in the tyranny of the majority. In face of this scenario, it would thus be possible to advocate against the instruments of direct participation. It is argued in this article that the tyranny of the majority is not an inherent element to the institutes of direct participation and that the understanding of this phenomenon demands an analysis of the social, political and institutional normative contexts. In order to substantiate such perspective, it will be employed several facts and analysis related to the application of the institutes of direct democracy in the United States and Switzerland. Finally, it is concluded that the mechanisms of direct democracy must be developed within a certain legal framework in order to potentialize the participation of citizens in the control of the power or to hinder the presentation of conservative populist themes to the direct popular decision.

No raras veces, iniciativas y consultas populares tienen como finalidad bloquear o neutralizar garantías de derechos para agrupamientos de la sociedad como indígenas, inmigrantes, mujeres, minorías raciales, homosexuales etc. Se habla, en ese sentido, del riesgo de la manifestación popular redundar en la tiranía de la mayoría. Delante de tal escenario, sería posible entonces abogar contrariamente a los instrumentos de participación directa. Sin embargo, se argumenta en este artículo que la tiranía de la mayoría no es un elemento inherente a los institutos de democracia directa y que la comprensión de esos fenómenos exige un análisis de los contextos sociales, políticos y normativos institucionales. Objetivando fundamentar esa perspectiva, se presentarán algunos datos y análisis referentes a la aplicación de los institutos de democracia directa en los Estados Unidos y Suiza. Al final, se concluye que los mecanismos de democracia directa deben ser desarrollados dentro de determinado ordenamiento jurídico de modo a potencializar la participación ciudadana en el control del poder e impedir o dificultar que temas populistas de carácter conservador sean presentados para la decisión directa popular.Este artigo aborda o tema da democracia direta e a discussão quanto ao seu uso disfuncional refletido no ataque aos direitos de minorias sociais. Não raras vezes, iniciativas e consultas populares têm como finalidade bloquear ou neutralizar garantias de direitos para agrupamentos da sociedade como os indígenas, os imigrantes, as mulheres, as minorias raciais, homossexuais etc. Fala-se, nesse sentido, do risco de a manifestação popular redundar na tirania da maioria. Diante de tal cenário, seria possível então advogar contrariamente aos instrumentos de participação direta. Em chave oposta, argumenta-se neste artigo que a tirania da maioria não é um elemento inerente aos institutos de democracia direta e que a compreensão desse fenômeno exige uma análise de contextos sociais, políticos e normativos institucionais. Objetivando fundamentar essa perspectiva, serão apresentados alguns dados e análises referentes à aplicação dos institutos de democracia direta nos Estados Unidos e Suíça.
