INEQUALITY INCREASE WITH PUBLIC POLICIES OF EARLY CHILDHOOD EDUCATION AND HEALTH

Resumo: Brazilian public policies intended to reduce inequality have been ineffective, as shown by different studies, such as 2019 and 2020 Human Development Reports data. This paper's purpose is to understand – while focusing on education and health – why inequalities persist. A method based on public policies, legislation, theory and empirical data analysis was used. The propaedeutic research sought to present an interdisciplinary discussion starting from the idea that the Law is inserted in a complex society and receives its influences. The 2019-2020 Human Development Reports and 2018-2019 Continuous PNAD data  analysis suggest that there is inequality in parents capacity to provide education and health opportunities for their children. It can be checked that the investigated public policies, despite following the constitutionally proposed universality, do not meet the intended purposes in view of a non-inclusive structure and low intergenerational mobility.

O objetivo do artigo é compreender por que as desigualdades observadas no nascimento impactam a vida das pessoas, persistindo durante a vida, com foco mais voltado para educação e saúde. Utilizou-se como metodologia a análise de políticas, a legislação, a teoria e dados empíricos. A pesquisa de caráter propedêutico buscou apresentar uma discussão interdisciplinar por partir da ideia de que o Direito se insere numa sociedade complexa e recebe suas influências. A análise dos dados apresentados no Relatório de Desenvolvimento Humano 2019 e 2020, e da PNAD Contínua 2018 e 2019 sugerem que existe desigualdade de capacidade dos pais nas oportunidades de educação e saúde para a criação dos seus filhos.
