Resumo: This current monography proposes to discuss the constitutionality (or inconstitucionality) of the STF’s decision in the HC 126.292/SP, wich authorized the pacient’s anticipated custodial sentence, with the consequent denial of the order. The technical aspects of the decision will be analyzed with the presumption of innocence principle on the foreground. The analysis will also cover the relevant infraconstitutional legislation. A comparison will be made regarding the possibility of provisional execution of the custodial sentence in other western countries (some that adhere to Common Law system, others that adhere to Civil Law system), and also a panorama referred to the national jurisprudence (STF and STJ) concerning the subject.
