Terceirização e “pejotização” a partir da Lei nº 13.429/2017

Resumo: The article begins with general and conceptional notions about the consolidation of the Labour Laws and the brazilian context of the outsourcing services and thefore the “pejotização” in the current legal system. The bibliographical e documental research has the objetictive to demonstrate the attempt to dismantle the social and labour laws, through legislations and jurisprudential understanding focused on the profits of the holder of the power, the employer, under an especific sistematization of legal-dogmatic methodological approach, wich analyses the positioning of several authors of the field, through articles, periodicals, jurisprudence and legislation. It’s pointed and expetiated throughout the text about the unquestionable importance that is the discussion of the precarization of the labour laws e consequent victimization of the hipossuficient workers, of which are required to conform to what Capitalism dictates, to fit in the job market, a reality that distorces the work contracts and concretizes the “pejotização” as a pulsating reality in Brazil, amidst the various flexible ways of hiring. Finally, what stands out is the negative consequences of such retrocess and the importance of those rights to develop an equal sociaty.

Finally, what stands out is the negative consequences of such retrocess and the importance of those rights to develop an equal sociaty.Trabalho de Conclusão de Curso (Graduação)Inicia-se o artigo com noções gerais e conceituais sobre a Consolidação das Leis Trabalhistas, a contrarreforma trabalhista e o contexto brasileiro da terceirização e da “pejotização” no ordenamento jurídico atual. A pesquisa bibliográfica e documental possui como objetivo demonstrar a tentativa de desmonte dos direitos trabalhistas e sociais, a partir de legislações e entendimento jurisprudencial voltado para o lucro do detentor do poder, o empregador, sob uma sistematização específica de abordagem metodológica jurídico-dogmática, analisando-se o posicionamento de diversos autores estudiosos do ramo, por artigos, periódicos, jurisprudência e legislação. Aponta-se e discorre-se no decorrer do texto sobre a inquestionável importância da discussão sobre a precarização das leis trabalhistas e a consequente vitimização dos trabalhadores hipossuficientes e hipersuficientes, dos quais são exigidos que se amoldem aos ditames do capitalismo para se encaixarem no mercado de trabalho, realidade que desvirtua os contratos trabalhistas e concretiza a “pejotização” como uma realidade pulsante no Brasil, em meio às diversas formas flexíveis de contratação.
