Após ser feita uma abordagem da construção cultural da família no mundo e no Brasil e das motivações históricas que levam as pessoas a se casarem ou estabelecerem uniões estáveis, realiza um breve resumo da evolução legislativa das uniões informais no Brasil. Em seguida, aborda o conceito de união estável com base no Código Civil de 2002 e na Constituição Federal. Ainda na segunda parte, analisa o regime sucessório dos companheiros em comparação com o dos cônjuges e tece críticas ao primeiro. Na terceira parte do trabalho, analisa a inconstitucionalidade do artigo 1.790 do Código Civil de 2002, desenvolvendo o tema a partir dos princípios da igualdade, da afetividade, e da proibição de retrocesso social, sem a intenção de defender uma equiparação da união estável com o casamento. Foram utilizados os pensamentos de diversos doutrinadores e alguns julgados. Conclui pela inconstitucionalidade do citado artigo e estabelece a necessidade de que haja uma regulamentação mais justa em relação aos companheiros, que os coloque em situação digna e correspondente com o seu papel de parceria para a vida. ______________________________________________________________________________ ABSTRACTThis study aims to analyze the right of inheritance in the common-law marriage in the light of the Federal Constitution. After being made an approach to the cultural construction of family in the world and in Brazil and historical motivations that lead people to marry or establish stable unions, gives a brief summary of the legislative evolution of informal unions in Brazil. Then discusses the concept of common-law marriage on the Civil Code of 2002 and on the Federal Constitution. Also in the second part, analyzes the succession regime of companions compared to the spouses and criticizes the first. In the third part of the study, analyzes the constitutionality of Article 1790 of the Civil Code of 2002, developing the theme from the principles of equality, of affection, and of the prohibiton of social regression, with no intention of defending an equation between the common-law marriage and the wedding. It was used the thoughts of many scholars and some decided cases.
