The notion of linguistic rights and their guarantee in Brazil: between democracy and fascism

Resumo: This article presents the discussion regarding the meanings of the notion of linguistic rights, within their connections with the alleged “universal human rights”, as far as “individual rights” and “collective rights”. After a conceptual review, we present facts of Brazil linguistic diversity, focusing our analyses on the processes of language co-officialization in municipal levels and the declaration of languages as intangible heritage. Considering how a certain Europebased notion of linguistic rights has been inserted and spread among the Brazilian society, we suggest the need of producing a reterritorialization of this concept in another space of enunciation. At last, we put this policy of linguistic right acknowledgement through co-officialization on interpretation, enlightened by the concepts of democracy and fascism established by Boaventura de Sousa Santos (2016).

Luego de una revisión conceptual, presentamos hechos del diversidad lingüística en Brasil y la producción de la garantía de derechos lingüísticos en el espacio nacional, enfocando nuestro análisis procesos de cooficialización de lenguas a nivel municipal y declaración de lenguas como patrimonio inmaterial del Estado. Líder teniendo en cuenta la forma en que cierta noción de derechos lingüísticos, Matriz europea, aporta y circula en la sociedad brasileña, materializándose en la legislación lingüística del país, señalamos la la necesidad de producir una reterritorialización de este concepto en este otro espacio de enunciación. Finalmente, ponemos en relación esta política de reconocimiento de los derechos lingüísticos a través de la cooficialización con los conceptos de democracia y fascismo, definido de Boaventura de Sousa Santos (2016).Neste artigo, trazemos à discussão os sentidos da noção de direitos linguísticos, em sua relação com os ditos “direitos humanos universais”, tanto como “direitos individuais” quanto como “direitos coletivos”. Após uma revisão conceitual, apresentamos fatos da diversidade linguística do Brasil e da produção da garantia de direitos linguísticos no espaço nacional, focalizando nossa análise nos processos de cooficialização de línguas em nível municipal e na declaração de línguas como patrimônio imaterial do Estado. Levando em conta o modo como uma certa noção de direitos linguísticos, de matriz europeia, aporta e circula na sociedade brasileira, materializando-se na legislação linguística do país, apontamos a necessidade de se produzir uma reterritorialização desse conceito neste outro espaço de enunciação.
