The present study demonstrates the repercussion that has been on permission, or not, in relation to the rental of properties located in building condominiums through digital platforms. This study will approach the concept of the right to property, since this is a fundamental right which must attend its social function; concept of building condominium, demonstrating the institution of the condominium, the constitution of the Convention and the Internal Regulations, as well as the rights and duties of the tenants; concept on digital platforms, focused on Airbnb, as it is the subject of this study; finally, the bill that aims to regulate this new institute will be analyzed, as well as, it will be discussed about the position the courts are in according to the current jurisprudence. In this study, we adopted the theoretical method that addresses research of specific works and articles dealing with this topic.
