EXTRAJUDICIARY STANCE OF MULTIPARENTALITY AND ITS REPERCUSSIONS ON THE SUCCESSORY RIGHTS OF ASCENDANTS

Resumo: Current paper identifies, from the point of view of law, doctrine and jurisprudence, the acknowledgement of the multi-parent family and analyzes the development of effects within successory rights. As a sociological phenomenon, the family is subject to the dynamics that emerge from the relationships based on conviviality among individuals. However, the family currently presents itself under new formats and affects other related dimensions, such as property. Multi-parentality is a progress within family rights and shows the essentiality of the affective bond as a guarantee of the dignity of the human person within the family milieu. However, there is a deficiency in Brazilian law with regard to the prevision and solution of juridical effects derived from multi-parentality. The civil lawmaker failed to regulate the transference of property to multi-parent ascendants, coupled to the surviving spouse, and the succession of multi-parent ascendants within the pure mode.

La familia, como un fenómeno sociológico, se sujeta a la dinámica que emerge de las relaciones de convivencia entre los individuos. Hoy día, esta entidad se presenta bajo nuevos formatos, afectando otras dimensiones que a ella se relacionan, como el aspecto patrimonial. La múltiple parental es considerada un avance en el campo del derecho de familia, que demuestra la esencialidad del vínculo afectivo como forma de garantía de la dignidad de la persona humana en el ámbito familiar. En este campo, se verifica la deficiencia del ordenamiento jurídico brasileño cuando de la previsión y solución de los efectos jurídicos advenidos del reconocimiento de múltiple parental. El legislador civil dejó de reglamentar la transferencia de patrimonio de los ascendentes múltiple parentales en concurrencia con el cónyuge supérstite y la sucesión de los ascendentes múltiple parentales en la modalidad pura.A presente pesquisa tem por objetivo identificar a partir da legislação, da doutrina e da jurisprudência o reconhecimento da família multiparental e analisar os desdobramentos de efeitos no direito sucessório. A família, como um fenômeno sociológico, sujeita-se à dinâmica que emerge das relações de convivência entre os indivíduos. Hodiernamente, esta entidade apresenta-se sob novos formatos, afetando outras dimensões que a ela se relacionam, como o aspecto patrimonial. A multiparentalidade é considerada um avanço no campo do direito familiarista, que demonstra a essencialidade do vínculo afetivo como forma de garantia da dignidade da pessoa humana no âmbito familiar. Nesta seara, se verifica a deficiência do ordenamento jurídico brasileiro quando da previsão e solução dos efeitos jurídicos advindos do reconhecimento da multiparentalidade.
