The Invisibility of the Elderly Person and Civil Responsibility in Affective Abandonment

Resumo: Current research deals with the civil responsibility due to inverse affective abandonment and verifies the juridical consequences following physical or moral abandonment by offspring towards their elderly parents. Inductive research, employing bibliographical and documental review and field survey, involves elderly people in the Vitoria Asylum, Vitoria ES Brazil. Investigation shows the possibility of applying laws on civil responsibility through indemnity for moral harm in the wake of the violation of care due between parents and offspring. Results show the employment of the law to tutelage the juridical right in care and its employment as a prevention against frequent inverse affective abandonment towards a de-invisibility stance of the elderly.

El presente estudio se refiere sobre el análisis de la responsabilidad civil por el abandono afectivo inverso, de modo a averiguar cuales las posibles consecuencias jurídicas resultantes del abandono físico o moral de los hijos para con sus padres ancianos. Con vistas a la realización de este estudio se adoptó como método de investigación, el inductivo, con la utilización de las técnicas de revisión bibliográfica y documental acompañadas por investigación de campo, buscando, sobre todo, realizar un estudio junto a los ancianos institucionalizados en el Asilo de Vitória (ES). Se intenta, por intermedio de este estudio, demostrar la posibilidad de la aplicación del instituto de la responsabilidad civil en la forma de imposición de indemnización por daños morales frente a la violación del deber de cuidado existente entre hijos y padres. Como principales conclusiones, se destaca el uso del antedicho instituto de manera a tutelar el deber jurídico de cuidado y su utilización como acción preventiva de cuño inhibitorio a las prácticas de abandono afectivo inverso cada vez más frecuentes, ambos con vistas a contribuir a la no invisibilidad del individuo anciano.O presente estudo versa sobre a análise da responsabilidade civil pelo abandono afetivo inverso, de modo a averiguar quais as possíveis consequências jurídicas decorrentes do abandono físico ou moral dos filhos para com os seus pais idosos. Com vistas à realização deste estudo foi adotado como método de pesquisa o indutivo, com a utilização das técnicas de revisão bibliográfica e documental acompanhadas por pesquisa de campo, buscando, sobretudo, realizar um trabalho junto aos idosos institucionalizados no Asilo de Vitória (ES). Pretende-se, por intermédio deste trabalho, demonstrar a possibilidade da aplicação do instituto da responsabilidade civil na forma de imposição de indenização por danos morais frente à violação do dever de cuidado existente entre filhos e pais.
