Special Defense of the Person´S Rights: Tutelage Tools in Brazilian Law

Resumo: Since person´s rights are highly relevant subjective rights, they demand the execution of tutelage tools capable of promoting people´s defense against eventual offenses to their dignity. The broadness of tutelage mechanism of these rights will be forwarded, albeit briefly, as they are listed in Brazilian law. General concepts and the characteristics of the person´s rights are analyzed so that the manner several juridical branches, particularly Civil Law, produce protection in life and after death could be investigated.

El propósito de estas notas es el de presentar, aunque en pocas líneas, la amplitud de los mecanismos de tutela de tales derechos, tal como previstos en el ordenamiento jurídico brasileño. Para tal, serán tratadas las nociones generales y las características de los derechos de personalidad, para que se pueda, al fin, investigar de qué forma las diversas ramas jurídicas – especialmente el derecho civil – propician su protección, en vida o post mortem.Os direitos da personalidade, enquanto direitos subjetivos de irrecusável magnitude, demandam a imposição de instrumentos de tutela que sejam hábeis à promoção da defesa das pessoas contra eventuais ofensas à sua própria dignidade. O propósito destas notas é o de apresentar, ainda que em poucas linhas, a amplitude dos mecanismos de tutela de tais direitos, tal como previstos no ordenamento jurídico brasileiro.
