Sexual Diversity in the Labor Milieu and Personal Rights

Resumo: A contemporary analysis is provided on the ‘paradigmatic revolution’ emerging within the sexual milieu and which is spreading out throughout the constitutional order. Current article also brings forth issues within the labor milieu on sexual orientation and its prerogatives adequately labeled to ‘normal people’ by colloquial society. Although the Constitution disposes on the principle of Human Dignity as a basic principle, the right to solve human issues of current social crisis is required. The latter was duly based on Human Dignity, or rather, personal rights should be directed to those who cherish a life full of dignity. The recovery of the person through law, regardless of sexual and other issues, imposes on the lawmaker a trans-disciplinary attitude. This fact is also proper to the reforming legislator who integrates norms, values and facts and institutes the worker within the human condition.

Rescata cuestiones en el ámbito del trabajo, relativos a la libre orientación sexual y prerrogativas que, a rigor, están debidamente rotuladas a aquellos que son denominados como “normales” por la sociedad coloquial. A pesar de la Constitución disponer del Principio de Dignidad Humana como uno de sus fundamentos, se hace presente el derecho para solucionar las cuestiones humanas de la crisis hodierna, debidamente pautado por la Dignidad Humana, o sea, solo se hablará en derechos de personalidad para aquellos que gozan de vida digna. El rescate de la persona por el derecho, independientemente de cuestiones sexuales o cualesquiera, impone al jurista una postura trasdisciplinar, así como debe ser para el legislador reformador, buscando la integración entre norma, valor y hechos, reponiendo así el ser trabajador en la condición humana.A pesquisa traz uma análise contemporânea, mormente a “revolução paradigmática” que está emergindo no âmbito da sexualidade e se irradiando por toda a ordem constitucional. Resgata questões na seara trabalhista, relativamente à livre orientação sexual e prerrogativas que a rigor estão devidamente etiquetados àqueles que são denominados como “normais” pela sociedade coloquial. Malgrado a Lei Maior dispor o Princípio da Dignidade Humana como um dos seus fundamentos, mister se faz presente o direito para solucionar as questões humanas da crise social hodierna, devidamente pautado pela Dignidade Humana, ou seja, só há que se falar em direitos da personalidade para aqueles que gozam de vida digna.
