Judicialization in the Federal Supreme Court for the Protection of the Person´s Fundamental Rights

Resumo: The phenomenon of judicialization of life in the post-democratic stare and its consequences within established limits through rights are investigated. The relevant theme discusses the role of the judiciary in the State and its relationship with access to justice, fundamental rights and rights of the person. Among the hypotheses, one may highlight the effectiveness of access to justice, and its constitutional bond as a fundamental right prior to its embodiment in processes. Through the hypothetical and deductive method, current bibliographic and scientific journal research underscores the case and makes a comparative analysis of theories by Luís Roberto Barroso and Rubens Casara, with special emphasis on the types of decisions of the Brazilian Federal Supreme Court. Results reveal the influences of the judiciary and the break down of limits in favor of the neoliberal project, with a regression of the democratic state.

En la investigación se tiene como objetivo tratar sobre el fenómeno de la judicialización de la vida en el Estado tras democrático y sus reflejos en los límites establecidos a través de derechos. La temática es de gran relevancia, pues se cuestiona cuál es el papel del Poder Judiciario en el Estado y su relación con el acceso a la justicia, derechos fundamentales y de personalidad. Entre las hipótesis, se destaca la efectividad del acceso a la justicia, su vinculación constitucional como un derecho fundamental antes de la incorporación en los diplomas procesuales. Se utilizó del método hipotético-deductivo, con investigación bibliográfica y revista especializados, y demás referencias que destacaron el caso ejemplificado, haciéndose así un análisis comparativo de las teorías de Luís Roberto Barroso y Rubens Casara, haciendo hincapié a los tipos de decisiones del Supremo Tribunal Federal de Brasil. Se percibe en los resultados alcanzados las influencias en el poder judiciario y la quiebra de los límites en favor del proyecto neoliberal, representando un retroceso del Estado democrático y de Derecho. A pesquisa tem como objetivo tratar sobre o fenômeno da judicialização da vida no Estado pós-democrático e seus reflexos nos limites estabelecidos através de direitos. A temática é de altíssima relevância, pois questiona-se qual o papel do Poder Judiciário no Estado e sua relação com o acesso à justiça, direitos fundamentais e de personalidade. Dentre as hipóteses, destaca-se a efetividade do acesso à justiça, sua vinculação constitucional como um direito fundamental antes da incorporação nos diplomas processuais. Utilizou-se do método hipotético-dedutivo, com pesquisa bibliográfica e revista especializados, e demais referências que destacaram o caso exemplificado, fazendo assim uma análise comparativa das teorias de Luís Roberto Barroso e Rubens Casara, dando destaque para os tipos de decisões do Supremo Tribunal Federal do Brasil. Verifica-se nos resultados alcançados as influências no poder judiciário e a quebra dos limites em favor do projeto neoliberal, representando um retrocesso do Estado democrático e de Direito.
