Resumo: | The number of cosmetic plastic surgeries in contemporary society has increased enormously either because of human vanity and consumerism or because of the psychic dissatisfaction with the patient’s well-being. Scientific and technological progress and easy access to surgical techniques contribute towards the popularity of the procedure. When the patients opt for plastic surgery, they strongly believe that the result will give the expected and desired shape, according to the doctor’s promise. However, in certain cases, the result promised by the plastic surgeon fails. This fact implies in the civil liability of the plastic surgeon with regard to the promised results; in other words, the client’s particular purpose was not achieved. Current essay shows that the juridical nature of the obligation consists of producing the desired results and this does not constitute the objectivity of the surgeon’s responsibility. The surgeon has to show that damage occurred from factors which were unrelated to the service provided. |

The surgeon has to show that damage occurred from factors which were unrelated to the service provided.El número de cirugías plásticas estéticas realizadas en la sociedad moderna viene creciendo de forma significativa, sea en ocurrencia de la vanidad humana incentivada por el consumismo o por las satisfacciones psíquicas relativas al bienestar del paciente. Los avances tecnológicos y científicos, bien como la facilitación al acceso de las técnicas de cirugías también contribuyen para la popularización del procedimiento. Al optar por la cirugía plástica, el paciente cree con vehemencia que el resultado final se dará de la forma deseada, de acuerdo con la promesa del médico. Lo que pasa es que, en determinados casos, el resultado prometido por el cirujano plástico no se verifica, lo que acarrea la responsabilidad civil del cirujano plástico en las cirugías estéticas a partir del resultado prometido, pues la obligatoriedad era de resultado, o sea, el médico se ha comprometido en lograr determinado resultado y este no fue obtenido. Desde esa perspectiva, se busca aclarar la razón por la cual la naturaleza jurídica de esa obligatoriedad no es de resultado, lo que no significa, por si solo, que la responsabilidad del profesional liberal sea objetiva, lo que ocurre es la transferencia para el médico del gravamen de demostrar que el evento dañoso ha ocurrido debido a factores ajenos a la prestación de servicio.O número de cirurgias plásticas estéticas realizadas na sociedade moderna vem crescendo de forma vultosa, seja em decorrência da vaidade humana incentivada pelo consumismo ou pelas insatisfações psíquicas relativas ao bem-estar do paciente. Os avanços tecnológicos e científicos, bem como a facilitação ao acesso das técnicas cirúrgicas também contribuem para a popularização do procedimento. Ao optar pela cirurgia plástica, o paciente acredita veementemente que o resultado final dar-se-á da forma desejada, de acordo com a promessa do médico. Ocorre que, em alguns casos, o resultado prometido pelo cirurgião plástico não se verifica, o que acarreta a responsabilidade civil do cirurgião plástico nas cirurgias estéticas a partir do resultado prometido, pois a obrigação era de resultado, ou seja, o médico se comprometeu a atingir determinado fim, e este não foi consolidado.
