The COVID-19 pandemic and the compulsory license of vaccines patents: an analysis of Bill 12, of 2021

Resumo: This article intends to provide a critical analysis of Bill 12, of 2021, which aims to facilitate the process of compulsory licensing of patents for vaccines against COVID-19. For this purpose, the article presents the concept of patents, the requirements for compulsory licensing per the current legislation, as well as an analysis of the scenario of the pandemic in Brazil and the importance of compulsory licensing of vaccine patents in this context. It concluded that, although the Project has as overall strengths the suppression of the need for Federal Government’s initiative and the provisional establishment of remuneration to the patent holder, it also has some technical inadequacies. Furthermore, and contrary to its objectives, Bill 12 has some points that increase the bureaucracy in granting the compulsory licensing. Deductive methodology is used with bibliographic and legislative research techniques and, as the main theoretical framework, Robert Alexy's theory of fundamental rights.

Para esto, son presentados el instituto y los requisitos para liberación de las patentes en la legislación vigente, así como una analice de la situación de la pandemia en Brasil y de la importancia de la liberación de patentes de vacunas en este contexto. Concluyó que, aunque el Proyecto tenga como puntos fuertes la supresión de la necesidad de iniciativa del Poder Ejecutivo Federal y la fijación provisoria de la remuneración del titular de la patente, tiene algunas impropiedades técnicas, además de otros puntos que, al revés de su objetivo, solo aumentan la burocracia en la liberación de las patentes. Utiliza la metodología deductiva con técnicas de investigación bibliográfica y legislativa y, como marco teórico principal, la teoría de los derechos fundamentales de Robert Alexy.O artigo pretende realizar uma análise crítica do Projeto de Lei nª 12, de 2021, cujo objetivo é facilitar o processo de concessão da licença compulsória de patentes de vacinas contra a COVID-19. Para tanto, são apresentados o instituto das patentes, os requisitos para a licença compulsória na legislação vigente, além de uma análise do cenário atual da pandemia no Brasil e da importância da licença compulsória das patentes de vacinas nesse contexto. Conclui-se que, embora o Projeto tenha como pontos positivos a supressão da necessidade de iniciativa do Poder Executivo Federal e a fixação provisória da remuneração do titular da patente, ele possui algumas impropriedades técnicas, além de outros pontos que, na contramão do seu objetivo, apenas aumentam a burocracia na outorga da licença compulsória.
