Resumo: It is known that consumer law has evolved over the years, and even before the COVID-19 pandemic, e-commerce has stood out, as it is a practical and quick means of purchasing and selling. But the lack of legal protection in the face of suppliers is also reflected in e commerce, and some of the rights covered by the legal system are the contradictory and the full defense, the reversal of the burden of proof, the deadline for repair, and the opposing request and counterclaim. If the lack of legal support was not enough, suppliers are burdened daily with bad faith litigation by malicious consumers, who abuse the right granted to them. The marketplace was one of the segments that grew the most during the pandemic, as it allowed small suppliers to have the opportunity to continue selling, allowing them to remain in the market, and opening the doors to a new sales modality, which only tends to grow. But it is true that contractual relations must be based on legal certainty, thus avoiding future conflicts between the parties. As an approach method, the deductive was used.

As an approach method, the deductive was used.Sabe-se que o direito consumerista evoluiu com o passar dos anos, e antes mesmo da pandemia da COVID-19 o comércio eletrônico vem se destacando, por ser um meio prático e rápido de compras e vendas. Mas, a falta de amparo jurídico em face dos fornecedores reflete também no e-commerce, e alguns dos direitos abordados pelo ordenamento jurídico são o contraditório e a ampla defesa, a inversão do ônus da prova, o prazo para conserto, e o pedido contraposto e reconvenção. Não bastasse a falta de amparo jurídico, os fornecedores são diariamente prejudicados onerosamente com a litigância de má-fé dos consumidores mal intencionados, que abusam dos direitos que lhes são concedidos. O marketplace foi um dos seguimentos que mais cresceram durante a pandemia, pois permitiu que pequenos fornecedores tivessem a oportunidade de continuar vendendo, possibilitando sua permanência no mercado, e abrindo portas para uma nova modalidade de venda, que só tende a crescer. Mas é certo que as relações contratuais devem ser pautadas na segurança jurídica, evitando, assim, futuros conflitos entre as partes.
