In fact, the history of the origin of the Brazilian penitentiary system shows that the structure of prisons was never one of the subjects most included on the agenda by the State. The above is evident when analyzing the situation of prisons in Brazil, especially women's prisons, with which the State was not always concerned. The truth is that prisons were not created to keep women, but men, because, although the number of female prisoners has grown significantly in recent years, the number of male prisoners remains higher. It is recorded that the state action with regard to the assistance of incarcerated women is not efficient due to the fact that women naturally already need specialized attention. In this context, the situation of pregnant women and incarcerated mothers is even worse, since, although there are legislative mechanisms focused on protecting these women in prison.
