The Libras Law and the right to health promotion for the Deaf in the advent of the COVID-19 pandemic in Brazil: a literature review

Resumo: The year 2020 was atypical for everyone in Brazil and in the world, marked by the SARS-CoV-2 pandemic, the virus that causes COVID-19. But the year was also important for the deaf community because the Brazilian Sign Language Federal Law 10.436 of April 2002, which recognized the Brazilian Sign Language as a language in Brazil, completed 20 years of officialization. In view of these events, this paper aimed to conduct a study in the period that elapsed since the approval of the law and to point out the main changes and advances in the health care for the deaf community provided by it, therefore, this paper also proposed to detect barriers there are still present, being faced by deaf people. For this purpose, we conducted a literature review of the last 20 years since the approval of the Brazilian Sign Language Law, analyzing the main literature and digital academic platforms. Accordingly, we identified in the various authors consulted numerous barriers still faced by deaf people in their access to health such as: the lack of advertisement on health promotion and on health prevention in Brazilian Sign Language for the deaf community; health professionals without proper qualification for adequate care in sign language, in the case of bilingual professionals, requiring a translator/interpreter of Brazilian Sign Language in medical appointments; the non-accessibility of information; difficulties in specific vocabularies and legal inapplicability of rights. It was further concluded that such factors were aggravated by the pandemic, the isolation, and the use of face masks as protective equipment.

Pero ese año también fue importante para la comunidad sorda, pues la Ley de la Lengua Brasileña de Señales (Libras), nº 10.436/02, que reconoció la lengua brasileña de señas como una lengua en nuestro país, completó 20 años de oficialización. Ante esos acontecimientos, el presente trabajo tuvo como objetivo realizar un estudio en este período que transcurrió de la aprobación de la ley, y apuntar los principales cambios y avances en el área de la salud para la comunidad sorda propiciadas por ella, así también se propuso en detectar barreras aún presentes y enfrentadas por los sordos. Por lo tanto, se realizó una revisión de literatura de los últimos 20 años desde la aprobación de la Ley de Libras, analizando las principales literaturas y plataformas académicas digitales. Sin embargo, identificamos en los diversos autores consultados innumerables obstáculos aún enfrentados por las personas sordas en su acceso a la salud tales como: falta de divulgación en Libras para promover la prevención en salud de la comunidad sorda, la falta de profesionales de la salud capacitados para brindar atención, ya sea en lengua de señas cuando estos son bilingües, o por falta de intérprete de Libras en consultas y atención, no hay accesibilidad de información, no existen vocabularios específicos y los derechos legales son inaplicables en su caso por falta de políticas públicas. Se concluyó que tales factores se vieron agravados por la pandemia, el aislamiento y el uso de tapabocas como equipo de protección, ya que muchas personas sordas necesitan leer los labios para comunicarse.O ano de 2020 foi atípico para todos no Brasil e no mundo, marcado pela pandemia do vírus SARS-CoV-2, responsável pela doença COVID-19. Mas o ano também foi importante para a comunidade surda, pois a Lei da Língua Brasileira de Sinais (Libras), n.º 10.436/02, que reconhece a Libras como uma língua em nosso país, completou 20 anos de oficialização. Diante desses acontecimentos, o presente trabalho teve como objetivo realizar um estudo neste período que decorreu da aprovação da lei e apontar as principais mudanças e avanços na área da saúde para comunidade surda propiciadas por ela, assim também se propôs em detectar barreiras ainda presentes e enfrentadas pelos surdos. Para tanto, realizou-se uma revisão de literatura dos últimos 20 anos desde a aprovação da Lei de Libras, analisando as principais literaturas e plataformas acadêmicas digitais. Sendo assim, identificamos nos diversos autores consultados inúmeros entraves ainda enfrentados pelas pessoas surdas em seu acesso à saúde tais quais: faltam divulgação em promoção e prevenção em saúde na Libras para comunidade surda, profissionais de saúde sem capacitação para atendimento seja em língua de sinais quando este bilíngue ou pela presença de tradutor intérprete de Libras nas consultas e atendimentos, não acessibilidade nas informações, dificuldades em vocabulários específicos e inaplicabilidade legal de direitos.
