Projecting the past into contemporary times: the novel “Capitães da Areia” and the rights of children and adolescents in Brazil

Resumo: The article aims to analyze, based on the mixture of fictional aspects and real elements, present in the novel “Capitães da Areia” written by Jorge Amado, in the 1930s, the absence of rights for children and adolescents in the Constitution in force at the time. With the anthropological approach and a humanistic geography as a backdrop, the resistance of this social segment in the face of constitutional and parental abandonment will be discussed. Next, the constitutionalization of the rights to protect these individuals will be chronologically outlined, consolidated through the Constitution of the Federative Republic of Brazil (1988) and the Child and Adolescent Statute – Law no. 8069 of 1990. The methodology basically consisted of the survey, reading and analysis of bibliographic sources such as articles, dissertations and theses that deal with the topic covered. In the final analyses, it was concluded that the reading of “Capitães da Areia” revealed itself as a projector of the past in contemporary times, unveiling the dilemmas that still persist regarding the rights of children and adolescents, despite the guarantees expressed in the Constitution.

Con el enfoque de la perspectiva antropológica y una geografía humanista como telón de fondo, se discutirá la resistencia de este segmento social ante el abandono constitucional y parental. Luego, se esbozará cronológicamente la constitucionalización de los derechos de protección de estas personas, consolidada a través de la Constitución de la República Federativa de Brasil (1988) y el Estatuto del Niño y del Adolescente - Ley n. 8069 de 1990. La metodología consistió básicamente en el levantamiento, lectura y análisis de fuentes bibliográficas como artículos, disertaciones y tesis que versan sobre el tema abordado. En los análisis finales, se infirió que la lectura de “Capitães da Areia”, se reveló como un proyector del pasado en la contemporaneidad, revelando los dilemas que aún persisten entre los niños y adolescentes, a pesar de las garantías expresadas en la Constitución.O artigo tem como objetivo analisar, a partir da mescla de aspectos fictícios e elementos reais, presentes na obra “Capitães da Areia” escrita por Jorge Amado, na década de 30, a ausência de direitos para crianças e adolescentes na Constituição vigente à época. Tendo como pano de fundo a abordagem da geografia humanista e um olhar antropológico, será tematizada a resistência desse segmento social frente ao abandono constitucional e parental. Em seguida, será delineado cronologicamente a constitucionalização dos direitos para proteção desses indivíduos, consolidados por meio da Constituição da República Federativa do Brasil (1988) e do Estatuto da Criança e do Adolescente – Lei n. 8069 de 1990. A metodologia consistiu basicamente no levantamento, leitura e análise de fontes bibliográficas como artigos, dissertações e teses que versam sobre a temática abordada.
