Resumo: This research aims to investigate the existence of civil liability of passenger transportation and food delivery apps due to traffic accidents. It sought to analyse the context of the emergence of these apps, the nature of the services they provide, the existence of a consumption relationship between the apps and the users and, finally, whether the apps respond for damages caused to users and for damages caused to third parties involved in the accidents and, if so, what is the extent of this responsibility. It concluded that the civil liability of the apps, in both situations, will be objective, based on the Consumer Protection Code. The technical-legal method with bibliographic, legislative and jurisprudential research technique was used to carry out this work.

Buscou-se analisar o contexto de surgimento destes aplicativos, a natureza dos serviços por eles prestados, a existência ou não de relação de consumo entre os aplicativos e os usuários e, por fim, se os aplicativos respondem civilmente em razão dos acidentes de trânsito perante os usuários e, também, perante terceiros e, caso positivo, qual é a extensão desta responsabilidade. Concluiu-se que a responsabilidade civil dos aplicativos, nas duas situações, será objetiva, com fulcro no Código de Defesa do Consumidor.
