Resumo: The article aims to analyze the right to freedom of expression in digital environments as opposed to the democratic model of Habermas. This is a relevant approach, since the migration of discourses to the digital field and the lack of digital regulation have led to the notorious phenomenon of the massive dissemination of false news, potentially harmful to the autonomous formation of public opinion and the consequent decisions about sociopolitical topics, serving the deliberative democracy teory as a paradigm of heterogeneous and participative popular expression. Methodologically, the research is qualitative and analytical, with bibliographic and jurisprudential strategies. It is also relevant to highlight the weighting of the individual right of expression against the collective right to common well-being and the historical and biographical aspects of Habermas that guide and, to a certain extent, explain the theory of communicative action.

It is also relevant to highlight the weighting of the individual right of expression against the collective right to common well-being and the historical and biographical aspects of Habermas that guide and, to a certain extent, explain the theory of communicative action.  O artigo objetiva analisar o direito à liberdade de expressão nos ambientes digitais em contraposição ao modelo democrático de Habermas. Trata-se de uma abordagem relevante e atual, posto que a migração dos discursos para o campo digital e a pouca regulamentação informática propiciaram o notório fenômeno da disseminação massiva de notícias falsas, potencialmente danosa à formação autônoma da opinião pública e as consequentes tomadas de decisões sociopolíticas, servindo a democracia deliberativa como paradigma de expressividade popular heterogênea e participativa. Metodologicamente, a pesquisa é qualitativa e analítica, com estratégias bibliográfica e jurisprudencial. Destacam-se ainda, como pontos relevantes abordados, o sopesamento do direito individual de expressão ante o direito da coletividade do bem-estar comum e os aspectos históricos e biográficos de Habermas que pautam, e em certa medida explicam, a teoria do agir comunicativo.Centro Universitário Salesiano de São Paulo - U.E.
