Resumo: This paper examines legal language as a complicating factor in access to justice. It analyzes the theoretical references that demonstrate the exclusion of the population to justice, due to the maintenance of traditional law and its status quo. It presents a basic research and exploratory method, using reference documents on the theme. Conceptualizes the term access to justice, reflecting on the inaccessibility of the law, especially for the less favored part of the population. Explains legal jargons as an essential element to the symbolic power of law. It discusses the differences between access to the judiciary and access to justice. Discusses the neutrality of legal science in the sense of being untouchable and irreproachable. Explains examples where elitist legal language renders justice ineffective. It discusses the responsibility of law in the maintenance of social order, imposed by the System, in the light of Bourdieu's ideas (1989). It explains about the symbolic power of the legal field and its language as a maintainer. It concludes that the universalization of law deepens social inequality, to some extent also through its language. It elucidates legal terms, through comparison with a linguistic dictionary. It points out that the choice of legal language is linked to the maintenance of the conditions of dominated and dominant in society. And that there is a demand in changing this choice, in order to improve communication.

Analisa as referências teóricas que demonstram a exclusão da população à justiça, em função da manutenção do direito tradicional e seu status quo. Apresenta pesquisa de natureza básica e método exploratório, utilizando documentos referências sobre o tema. Conceitua o termo acesso à justiça, refletindo sobre a inacessibilidade do direito, sobretudo pela parte menos favorecida da população. Explana sobre o jargão jurídico como elemento essencial ao poder simbólico do direito. Discorre sobre as diferenças entre o acesso ao judiciário e o acesso à justiça. Discute a neutralidade da ciência do direito no sentido de ser intocável e irretocável. Explica exemplos em que a linguagem jurídica elitista torna a justiça ineficaz. Discorre sobre a responsabilidade do direito na manutenção da ordem social, imposta pelo Sistema, à luz das ideias de Bourdieu (1989). Explana sobre o poder simbólico do campo jurídico e sua linguagem como mantenedora. Conclui que a universalização do direito aprofunda a desigualdade social, em certa medida também através de sua linguagem. Elucida termos jurídicos, através de comparação com dicionário linguístico. Aponta que a escolha da linguagem jurídica está ligada à manutenção das condições de dominados e dominantes na sociedade.
